We expect the Senate Committee on Rules and Administration to hold a markup for this bill later this month. S. 1 does not address the lack of a secret ballot resulting from a very small number of blind voters using an accessible ballot-marking device (BMD) or the need for vote-by-mail ballots to adhere to the Help America Vote Act and the Americans with Disabilities Act. President Riccobono has written a letter to Senators Klobuchar and Merkley urging that S. 1 be amended. His letter can be found at https://nfb.org/programs-services/advocacy/policy-statements/letter-senators-klobuchar-and-merkley-regarding-s-1. Please call or write your two senators and urge them to support the two amendments contained in this letter. These two amendments would: 1. Increase the number of ballot-marking devices in each polling place from one to two and require poll workers to actively and specifically offer the ballot-marking devices to voters with and without disabilities. 2. Require that states adhere to the requirements of the Help America Vote Act and the Americans with Disabilities Act with regard to vote-by-mail. When you call or email your senators you might say something like: "Hello, my name is [YOUR NAME], and I am a constituent of [SENATOR NAME]. I live in [CITY, STATE]. I would like to urge [SENATOR NAME] to propose two amendments to S. 1 that would protect blind voters? rights to a private and independent ballot. The first amendment would increase the number of ballot-marking devices in each polling place from one to two and require poll workers to actively and specifically offer the ballot-marking devices to voters with and without disabilities. The second amendment would require states to adhere to the requirements of the Help America Vote Act and the Americans with Disabilities Act with regard to vote-by-mail. Together, these two amendments will ensure that blind Americans are able to vote and that our ballots will be indistinguishable from others. Thanks." You can contact your senators by calling the Capitol Switchboard and asking for the office in question. The number is 202-224-3121. If you email your senators, please copy Jeff Kaloc at jkaloc at nfb.org . Your calls and emails do make a difference. It is best to call or email the relevant voting staffer in your senators? offices. If you need the name and email of the appropriate staff person for any Senate office, please email Jesa Medders at jmedders at nfb.org . Thank you for all that you do. For your convenience, the content of President Riccobono?s letter is below. Warm Regards, John Dear Chairwoman Klobuchar and Senator Merkley: The National Federation of the Blind, the premier membership and advocacy organization of blind Americans, urges that the For the People Act of 2021 (S. 1) be amended with regard to requirements for ballot-marking devices and the process of requesting, completing, and submitting vote-by-mail ballots. As you may already know, ballot-marking devices allow blind or print-disabled persons to accessibly and independently complete their ballot. These machines are typically not used by non-disabled voters, but they offer several advantages. Ballot-marking devices eliminate stray marks, prevent voters from over voting, and enable voters to change their selection before the ballot is printed. However, these machines will frequently print a paper ballot that differs in both size and style from traditional paper ballots. Because so few non-disabled voters use the ballot-marking devices, the distinguishable ballot produced by the machine prevents blind and other disabled voters from having a secret ballot. To ensure that blind and print-disabled voters are able to cast both a secret and independent ballot, it is essential that S. 1 be amended, so that ballot-marking devices are not restricted to only voters with disabilities. We propose striking the existing language in Section 1503(a) and replacing it with: (a) IN GENERAL. ?Section 301(a)(3)(B) of the Help America Vote Act of 2002 (52 U.S.C. 21081(a)(3)(B)) is amended to read as follows: ?(B) satisfy the requirement of subparagraph (A) through the use of at least two direct recording electronic voting systems or other voting system equipped for individuals with disabilities at each polling place and: (i) the use of such voting systems shall not be restricted to voters with disabilities and must be actively and specifically offered as a voting method to all voters, regardless of whether the voter does or does not have a disability; and (ii) all state board of elections must conduct training of poll workers on the use and operation of such voting systems and on the policy that poll workers must actively and specifically offer such voting systems to all voters, regardless of whether the voter does or does not have a disability.? Furthermore, more Americans than ever before are choosing to vote by mail, therefore it is essential that blind Americans not be excluded from this opportunity. In that regard, S. 1 must be amended to ensure that the process for requesting, completing, and submitting a vote-by-mail ballot is nonvisually accessible. S. 1 currently states in Section 1101: ?Rule of Construction. ? Nothing in this section may be construed to allow the marking or casting of ballots over the internet." We urge that this ?Rule of Construction? be stricken and replaced with the following: ?Rule of Construction. ? Nothing in this law shall be construed to limit or alter a state?s obligations under Section 301(a)(3)(A) of the Help America Vote Act of 2002 and Title II of the Americans with Disabilities Act as amended.? This would ensure that Congress is preserving the accessibility requirements of these two landmark laws. Ensuring the accessibility of in-person and vote-by-mail balloting will guarantee that blind Americans are able to exercise their right to vote in a safe and secure manner without having to wait in long lines and crowded areas for extended periods of time. It is essential to incorporate the above amendments into the bill in order to guarantee that blind Americans are able to vote privately, independently, and secretly. Without these amendments to the bill, Congress would be reversing decades of progress in voting rights for Americans with disabilities. If the National Federation of the Blind can be of assistance in any way, especially by utilizing the nonvisual access to voting best practices and innovations we have developed over the past decades, please do not hesitate to contact us. We are fully prepared to help in any way that we can, in order to guarantee that all Americans, especially blind Americans, can confidently participate in our electoral democracy. Sincerely, Mark A. If you or someone you know has experienced sexual violence, you are not alone. The National Sexual Assault Hotline offers free, confidential support, 24/7, at 1-800-656-HOPE (4673) or at online.rainn.org. Dear Federation Family: On December 16, 2020, I wrote to you about the pain of Federation members, former members, and other people within our blindness community. This letter is a follow up to that communication and part of my accountability to you as your President. In this letter, as with the work we have been undertaking since December, I will not address specific allegations. We will focus instead on the steps we are taking to ensure our movement is as safe as possible for everyone. It is also my hope that it clarifies misinformation circulating about our work and our intentions, as well as the depth of our efforts and the plans ahead. We begin this letter by thanking each of you who have given your time, emotional energy, expertise, and heart to helping our community move forward. Thank you for making our movement what we all want it to be. I continue to be humbled and deeply informed by each powerful personal story that is shared with me by survivors. There is still much work and healing to be done, but together our work is making a real difference every day. In the December 16 open letter, the following initial priorities were laid out to guide our safety and support initiatives: * improvements to reporting of incidents * open meetings and support of survivors * enhancing our Code of Conduct * clarifying and enforcing expectations * continuous training and consistency among NFB training centers The following is a summary of the steps we?ve taken: Survivor Leadership and RAINN Partnership At the beginning of 2021, we announced a partnership with RAINN (Rape, Abuse & Incest National Network), the nation?s largest anti-sexual violence organization, and established the Survivor Task Force to help provide guidance on behalf of blind survivors. Working with RAINN, we have created and conducted mandatory trainings for all national board members; national division and affiliate board members; NFB training center staff, students, and boards; national staff; scholarship committee members; and task force members. Nearly one thousand people will have received this training by the end of April. Our experience with these trainings will inform development of our next phase of training, expected to roll out this fall. This will include training for chapter-level leaders and expanded training offerings for those working with youth. In the meantime, training is planned to ensure that all individuals involved with our 2021 summer programs including NFB BELL and NFB EQ are appropriately trained and clear about our expectations for working with minors. Training is in addition to background check processes that were already in place. Special Committee Independent Investigation On January 6, 2021, the board of directors of the National Federation of the Blind unanimously established a special committee to oversee and direct an internal investigation of allegations of sexual misconduct and abuse by NFB members, participants, or staff at NFB or NFB-affiliated events, facilities, or training centers, and the adequacy of NFB's and its affiliates' response to such allegations. The committee directs its own work and has complete authority to examine all aspects of the organization. Its independent work has guided and continues to guide the steps we are taking to create a safer culture across all NFB affiliates, events, and programs. The committee hired an outside law firm, Kramon & Graham, to help with the internal investigation. The four members of the special committee include an attorney, two affiliate presidents, and a current NFB board member. None of these individuals have been named in any allegations being reviewed by the special committee. To ensure the independence and integrity of their investigation, the special committee will communicate directly about its work in the coming weeks and months. Code of Conduct Independent External Investigator Since December 2020, all reports of sexual misconduct, abuse, and harassment are reviewed by an independent investigator, Tonya Ba?a LLC, to preserve their confidentiality. Once a report is thoroughly investigated, a report of findings is submitted to the Federation for action. The report is considered by a two-member panel of national board members who do not have conflicts of interest in the case. Recommendations are forwarded by the panel to the President who issues rulings. All rulings are appealable. To date, all final rulings have been completely consistent with the recommendations of the external independent investigator. Climate Assessment Survey and Report As an additional initiative, RAINN will execute a climate assessment by gathering feedback from NFB community members to help inform recommendations for further sexual misconduct prevention and response programming. This effort will assist in determining additional and continuous training, which will ultimately provide consistency across the organization. This is a baseline measurement to target our future efforts and will continue to be assessed as a component of our accountability measures. Please participate in the assessment survey which is expected to be available later this month. The anonymous survey will result in RAINN delivering two reports: one internal and one public-facing, detailing findings and implications that will be shared at the time of our 2021 national convention. Response Protocols and Code of Professionalism The NFB Code of Conduct remains in place to set expectations within our organization, and we have published the Code of Conduct FAQs to improve clarity and ease of understanding. All current reports submitted will be reviewed, regardless of when the incident occurred. In addition, we are thoroughly reviewing our code of conduct. This work is on-going. We have instituted the following immediate changes based on your feedback, as well as input from RAINN, the survivor-led task force, and the independent investigator. * We improved communication protocols to ensure leaders of the Federation are notified when individuals have been removed or suspended from the organization. * We strengthened the appeals protocols to ensure that survivors have more time to respond to rulings they feel are not satisfactory for healing. * We distributed interim guidance to Federation leaders to encourage sharing of information about incidents at all levels of the organization so patterns can be tracked nationally. The guidance is intended to balance the obligations of leaders to share information with the need for survivors to consent and guide the sharing of their stories. In addition to the immediate changes we have made, prior to July, RAINN will be leading us through the development of a set of customized and actionable standards of professionalism to address sexual misconduct and strategic response protocols. The standards will clarify and emphasize appropriate behaviors for members of the NFB community and act as the foundation for a safer, healthier organizational culture. Training Center Coordination The directors and board chairs of our three training centers have been coordinating improvement efforts. In addition to training for staff and students, each center has been examining its policies and procedures to ensure correct practices are in place. In addition, the Federation has been reviewing and updating its oversight of affiliated training programs. We are also working with our training centers and RAINN to strengthen and implement protocols to ensure we have a uniform approach, that all local regulations are clearly followed, and that we have consistent communication throughout the Federation. That work will be fully implemented after our convention this summer. Next Steps and Our Commitment to You Every member of the Federation should be proud of the work we are undertaking and the speed with which it is happening. But there is still much more to do. We need all leaders of the Federation to continue to reflect the expectations of our code of conduct and to help facilitate a supportive culture when survivors disclose information about incidents within the organization. We continue to seek feedback from members and nonmembers regarding safety and support. Your voice and experiences in these efforts are crucial. Open meeting announcements, ways to become involved with the work of the Survivor Task Force, and an archive of updates and resources can be found at nfb.org/survivors. We will be making another report of our progress and next steps at the 2021 national convention. These decisions will be grounded in on-going deep listening and best practices that result from working with RAINN, input from our survivor-led task force, recommendations of the special committee, and the input of all of you. Your voice is critical in this process. We promise to march with you to a stronger future that we build together. More than words, we know that trust is built through actions that are meaningful, visible, and sustainable. We continue taking all necessary steps to earn that trust and ensure blind people can lead their best lives. We are not yet done with our changes, and together we will move closer every day to fulfilling the commitments we have made in our movement. Sincerely, Mark Riccobono, President officeofthepresident at nfb.org, 410-659-9314 The National Federation of the Blind Board of Directors shown below affirms our support and commitment to the content of the above letter from our President. Each of us are available to answer questions and concerns from members. We continue to encourage the reporting of any incidents so they can be independently investigated. Today, Secretary of Homeland Security Alejandro N. Mayorkas announced the Department of Homeland Security (DHS) is extending the REAL ID full enforcement date by 19 months, from October 1, 2021 to May 3, 2023, due to circumstances resulting from the ongoing COVID-19 pandemic. The pandemic has significantly impacted states? ability to issue REAL ID-compliant driver?s licenses and identification cards, with many driver?s licensing agencies still operating at limited capacity. DHS will publish an interim final rule in the coming days to effectuate this enforcement date change. ?Protecting the health, safety, and security of our communities is our top priority,? said Secretary Mayorkas. ?As our country continues to recover from the COVID-19 pandemic, extending the REAL ID full enforcement deadline will give states needed time to reopen their driver?s licensing operations and ensure their residents can obtain a REAL ID-compliant license or identification card.? Beginning May 3, 2023, every air traveler 18 years of age and older will need a REAL ID-compliant driver?s license or identification card, state-issued enhanced driver?s license, or another TSA-acceptable form of identification at airport security checkpoints for domestic air travel. All 50 U.S. states, the District of Columbia, and four of five U.S. territories covered by the REAL ID Act and related regulations are now compliant with REAL ID security standards and are issuing REAL ID-compliant driver?s licenses and identification cards. However, many state licensing agencies have extended the deadline for renewing expiring licenses due to a widespread shift to appointment-only scheduling protocols during the pandemic that has significantly limited states? capacity to issue REAL ID-compliant driver?s licenses and identification cards. As a result, only 43 percent of all state-issued driver?s licenses and identification cards are currently REAL ID-compliant. DHS and various states also need time to implement requirements mandated by the REAL ID Modernization Act, including changes that will streamline processing by allowing the electronic submission of certain documents. DHS continues to work closely with all U.S. states, the District of Columbia, and U.S. territories to implement REAL ID Act requirements. This effort will assist in determining additional and continuous training, which will ultimately provide consistency across the organization. This is a baseline measurement to target our future efforts and will continue to be assessed as a component of our accountability measures. All responses go directly to RAINN and are completely anonymous. RAINN will deliver a report detailing findings and implications that will be shared at the time of our 2021 national convention. Take Survey via Web or Phone Participate in the assessment survey either via the web or by phone. It will take approximately thirty to forty-five minutes. Please complete by Wednesday, May 12, 2021. If you or someone you know has experienced sexual violence, you are not alone. The National Sexual Assault Hotline offers free, confidential support, 24/7, at 1-800-656-HOPE (4673) or at online.rainn.org We are writing to you as the members of the Special Committee established by the National Federation of the Blind. We believe it is important to update the NFB community about who we are, why we agreed to serve on this committee, and the work we are undertaking. What We Are Doing The Board established the Special Committee on January 6, 2021 to oversee and direct an internal investigation of allegations of sexual misconduct by NFB members, participants, or staff at NFB or NFB-affiliated events or facilities, including its affiliated training centers and its state affiliates ? as well as the adequacy of the response to such allegations. The Committee is examining all previously adjudicated NFB Code of Conduct complaints involving sexual misconduct and reviewing matters that have not been submitted through the Code of Conduct process but have come to the attention of the Committee. We are examining complaints involving the NFB itself, the three NFB affiliated training centers, as well as NFB affiliates and programs. The Special Committee will generate a report, which will be made public around the time of the NFB National Convention, with our findings and recommendations. The report will not disclose the identity of transgressors or victims/survivors. The purpose of the Special Committee is to gather a group of experienced individuals and leaders from within the NFB membership who can use our collective understanding of the organization?s history and structure to effectively determine what occurred, assess how NFB officials handled cases of sexual misconduct, determine whether patterns and trends exist that require systemic change, and recommend organizational and policy changes to prevent sexual misconduct cases from occurring in the future. The purpose of the committee is not to take the place of the external investigator, Tonya Ba?a. The Committee has already made certain recommendations, which have been implemented and will be discussed in its report. For example, the Committee recommended that the NFB eliminate the one-year filing deadline for Code of Conduct complaints during the pendency of this investigation. It?s important to underscore that the Board gave the Special Committee full authority and freedom to conduct its investigation. The Special Committee has full access to all internal records, staff, and anything else it deems pertinent. We are confident that we have the autonomy necessary to oversee a thorough and independent investigation. The Special Committee has engaged the services of Kramon & Graham, a Baltimore-based law firm, to conduct the needed interviews and advise the Committee accordingly. This firm has a well-established reputation and extensive experience conducting independent investigations, including cases involving alleged sexual misconduct. The Special Committee is relying on attorneys from Kramon & Graham to meet with individuals to gather information about alleged misconduct and how cases were handled by the NFB. The information collected by Kramon & Graham will inform the final report of the Special Committee. To be clear, Kramon & Graham was not engaged to defend the NFB against any allegations and its team reports solely to the Special Committee. NFB has separately engaged an external investigator, Tonya Ba?a LLC, to investigate individual cases involving sexual misconduct that have been filed through the NFB Code of Conduct since mid-December 2020. Kramon & Graham and Ms. Ba?a are not affiliated with one another and serve different roles, and neither has been hired to defend the NFB. Read about the NFB?s response to these issues. Your Role As this investigation continues, we need your help. We urge you to share information about past experiences of possible misconduct or cases in which NFB policies and procedures were considered ineffective or not followed. To take action, we must hear directly from those who experienced misconduct and those who witnessed it. We cannot act on rumor and innuendo. That information will help us develop a thoughtful plan to strengthen NFB systems and policies to prevent sexual harassment and misconduct and protect members. Individuals? personal information will be kept confidential in the internal investigation. We encourage people to share this information through the NFB Code of Conduct complaint process . If for some reason individuals choose not to use that process, please contact Jean Lewis at Kramon & Graham at jlewis at kg-law.com . We recognize that some may find it difficult to share their experiences. Please know that we are doing everything in our power to ensure that the investigatory process is grounded in respect for survivors and based on best practices for working with those who have experienced trauma. Finally, we ask the community?s patience as we conduct this investigation and develop recommendations to prevent sexual misconduct in NFB programs. We urge the community to hold judgment on specific incidents until we complete our investigation and issue our findings. We are deeply concerned about the harm that discussing rumor and innuendo is doing to survivors and want to ensure that they feel safe both in the community and engaging with the investigation. About the Special Committee Each of us are members of the NFB with a longstanding commitment to its mission and work. (Please see brief bios about us below.) We believe in NFB?s work and value the life-changing programs it provides to thousands of blind people. We also understand that this is a pivotal moment for NFB. We must make sure that NFB provides a safe environment to ensure that those who come after us benefit from NFB?s programs. We recognize that we must do a full accounting of where the organization failed in the past before we can change policies and protocols to ensure the safety of all those who engage with the organization in the future. We are confident that we have the ability and professionalism to oversee this investigation, and we will not hesitate to make difficult recommendations. We believe these recommendations and findings will lead to important new safeguards that will protect the community that each of us has tirelessly served. We will continue our work over the next several weeks and will report to the NFB community around the time of the national convention. Thank you for allowing us to work on these important issues on behalf of all members of NFB. We hold the safety of all blind people in mind as we advance this important review of our movement.
