Many of you are familiar with the Uber case. For those who are not, Uber is inconsistent at best concerning following the access laws in so far as guide dog users' rights are concerned. While some have had success at using Uber and other similar programs other guide dog users have been denied access to Uber vehicles which is in direct violation of the ADA and state laws. This is a case that should concern all guide dog users and every guide dog school. I hope that not only will users come to the hearing but that representatives of GDB and other schools will also attend. Best, Michael Hingson From: Timothy Elder [mailto:telder at trelegal.com] Sent: Tuesday, February 03, 2015 4:37 AM To: Timothy Elder Cc: Michael Nunez Subject: RE: Uber Hearing in San Francisco Hello all, We have the recently rescheduled court hearing date in the Uber case. On Tuesday, March 3, 2015, Plaintiffs will be appearing before the court in our suit against Uber to argue against Uber's motion to dismiss. Uber boldly contends that all disputes must be resolved through arbitration out of court on an individual basis and that Uber is not subject to the ADA. We intend to forcefully argue against Uber's points before the judge with the support of the U.S. Department of Justice, which recently filed a statement in our favor. We invite dog users from the community to attend the hearing and support our efforts. Uber needs to understand the solidarity of the community around this important issue. All are welcome to watch what is likely to be a vigorous argument. Please note that many dogs may be in close proximity. Preferred courtroom dress is business casual for nonparties and business suits for parties. Service animals should be recently groomed. After the hearing We are likely to gather for a social event in the Civic Center area. Please R.S.V.P. to telder at trelegal.com or 410.415.3493 so we have an idea of how many people to expect. I do not like Uber just for the reasons mentioned in this case. I think it is ridiculous that they have treated potential customers in the way they have and have denied access to the vehicles. I have talked to many people that have mentioned using Uber and told them how they have treated service dog users and don't support their business until they change their policies. I am a puppy raiser and have never used them but I am very upset that they have gotten away with the treatment of service dog users so any of you that can make that hearing please go. More businesses need to learn and appreciate what these dogs do for you and others. Take Care and Have A Tail Waggin Day! I'm hoping that she will be able to join us at our state convention in a few months. In the meantime, cagdu meetings are held every second Sunday of each month at 6:30PM pst. Please let me know if this time and day does not work for people. The cagdu board is planning to have speakers at least every other month and would like all guide dog users to come and participate. Also, we are going to be working on an initiative that will require all of our efforts. Thank You. As some of you may know, for the last couple of weeks, W-rose has not been feeling well. When we came home from Washington Seminar, I noticed she had very soft to runny stool. I took her into the vet, who checked her out, but did not find a lot, as the sample they took, was not a lot, so it did not give them a good reading. I continued to have the issue, so last Thursday, we changed her food, and that did not change anything. So, since she is a lab, when she was not eating, I called the vet again, and they wanted her in today. My mom picked her up, because I had a chapter meeting to run, took her to the vet, left her there, and then went back late in the day to pick her up. The school called me after they received the xrays, to tell me, the news that I was afraid of. W-rose has a very large mass in her stomach and chest area. I am so deeply sadded, I don't know what else to say. Message-ID: Hi All, A friend sent this article to me. I thought many of you might be interested to read it. From, Lisa Irving and Bernie Fake service dog investigation: Finding the people behind the lucrative online business February 10, 2015, by Heidi Hemmat, Updated at 10:03pm, February 10, 2015 Source: http://kdvr.com/2015/02/10/fake-service-dog-investigation-finding-the-people -behind-the-lucrative-online-business/ DENVER - It takes hard work, dedication and years of training to become a service dog, but imposters are giving good dogs a bad name. A FOX31 Denver investigation found dozens of websites selling service animal certifications, animal vets and ID cards to pet owners so they can take their furry friends into restaurants, malls and airplanes. National Service Animal Registry (NSAR), which originates in Colorado, offers service animal certifications, vests and badges for $64. Also for sale on the website . emotional support animal kits from Chilhowee Pyschological Services for $164 which includes a letter from a licensed therapist. The letter certifies a pet as an emotional support animal. We wanted to know what we would get, so a FOX31 Denver producer, who has a cat, ordered the support animal kit. The kit required the producer to take an online test and talk on the phone twice with a woman who said she was calling from Sutherland Counseling. A letter from a licensed professional counselor certifying our producer as mentally disabled arrived in the mail. The letter was signed by Stanford S. Sutherland and said our producer "is under my care ." and that he is currently treating her for a "mental health disability." Sutherland never saw our producer as a patient nor did he ever speak to her on the phone. Chilhowee Psychological Services website features clinicians, CEO Timothy Livingood, a certified counselor in Oregon and Stanford Sutherland, a licensed professional counselor (LPC) in Colorado Springs. Both NSAR and Chilhowee Psychological Service's websites are operating from the same location inside an office building in Woodland Park, Colorado. We wanted to speak to counselor Sutherland and the company's CEO. A statement from Livingood said in part: "Are we certain that every customer has a valid disability? Because our products are not required and carry no legal authority, it is possible that some customers are dishonest in an attempt to take advantage of the legal system by posing as disabled (although the products may be purchased elsewhere with no questions asked, while (we) requires a customer to affirm they qualify as disabled." HEIDI HEMMATFOX31 Denver did not hear back from Sutherland, so we went to the offices for Chilhowee Psychological services and the National Service Dog Registry in Woodland Park. There we found no counselors or dog trainers inside, just service animal vests and people who appeared to be processing orders. An employee told us we were at Chilhowee's administrative office and then a supervisor told us to leave. Sutherland Counseling is located 20 miles away in Colorado Springs. FOX31 Denver requested an interview with the counselor who certified our producer with a mental health disability, but Sutherland refused to come out of a private office. His wife, Lillie Sutherland said, "You need to go on our website, you need to contact me and I will talk to you when I'm not so busy." We did what Mrs. Sutherland asked, but she still refused to talk to us. Sean Boyd, the president of the Colorado Counselor's Association said it's impossible to diagnose a mental disability with an online test and two phone calls. Boyd said, "There are a lot of red flags for sure. This is a really big label, it's a very serious diagnosis and the course of treatment needs to be handled with care." Boyd believes the counselor could be violating the counselor's code of ethics. Boyd said, "That's very upsetting to me. That should not be happening. That should not be happening. Multiple stroke survivor, Natalie Hunter and service dog owner said people posing pets as support animals makes her life more difficult. Hunter said what Sutherland is doing is not just ethically wrong, but is criminal. Hunter said, "It should be looked into as a crime." The Colorado Department of Regulatory Agencies, or DORA, can take action against a counselor's license, but it has to receive complaints about Sutherland's practice before the counselor's board will investigate. CEO, Tim Livingood, doesn't have to worry about that. He claims to be a "certified counselor" in Oregon, but Oregon's licensing board confirms he has never had a license. There is a Colorado law that prohibits people from passing themselves off as disabled, CO-18-13-107, it is a class 1 petty offense -------------- next part -------------- An HTML attachment was scrubbed... Message-ID: <018f01d04f2a$907bfd50$b173f7f0$@gmail.com> Subject: Uber put on blast for slighting blind riders? Uber put on blast for slighting blind riders? By AJ Willingham HLNtv Fri February 20, 2015 A Twitter user accused Uber of denying his blind friend a ride, and now the company is having to answer for their drivers' alleged questionable practices. Colin Lawrence claimed Thursday that his friend Justin Chan couldn't catch a break with Uber drivers because he has a guide dog. An Uber rep responded swiftly, but not swift enough to avoid an uncomfortable comparison. Apparently, this is far from the first time Uber drivers have been accused of discriminating against blind riders with guide dogs. In 2014, the National Federation of the Blind of California filed a complaint against Uber, saying the company's drivers had refused service to blind riders, or otherwise compromised their experience, at least 30 times. One person involved in the complaint said he was denied service multiple times because of his guide dog, and another said a driver locked her guide dog in a trunk. At the time of the suit, Uber released a statement saying they do not tolerate discrimination based on disability and would deactivate any driver who was found to be exhibiting such behavior. "The Uber app is built to expand access to transportation options for all, including users with visual impairments and other disabilities," Uber said in a statement to USA Today. HLN reached out to Uber for comment, but has not heard back as of the writing. More than 3,000 online complaints have been filed by dog-owners claiming Purina Petcare Beneful?s dry ?kibble? variety is killing and hurting dogs, according to the class action lawsuit filed Feb. 5 in federal court. The brand is still on store shelves in the Tri-State area (Ohio, Kentucky, Indiana) and has not been recalled. This class action suit concerns "kibble" dry food, which includes "Purina Beneful Health Weight"; "Purina Beneful Original"; "Purina Beneful Incredibites," and "Purina Beneful Healthy Growth for Puppies", "Purina Beneful Healthy Smile", "Purina Beneful Health Fiesta", "Purina Beneful Healthy Radiance", and "Purina Beneful Playful Life" varieties. The packaging used for these foods make the following claims, the suit claims: ? "Satisfaction Guaranteed. If you're not happy, we're not happy. Complete satisfaction or your money back..." ? "At Purina, we're unconditionally devoted to pets. We've dedicated over 80 years to developing the high-quality products that satisfy the needs of dogs and cats." ? "100% Complete and Balanced Nutrition" ? Yes, dogs can have it all -- and should! How? A special blend of wholesome ingredients, including grains, real beef, and accents of vitamin-rich veggies! It gives dogs the complete nutrition they need and a taste they love." (Beneful Original) ? "Made with wholesome rice, real chicken, soy, and accented with veggies and apples, it has the complete nutrition adult dogs need..." (Beneful Healthy Weight) ? "With real chicken, wholesome rice, and accents of vitamin-rich veggies, it has the complete nutrition puppies need..." (Beneful Healthy Growth for Puppies) ? "When your puppy is grown, Beneful has so many delicious ways to help keep him healthy and happy." (Beneful Healthy Growth for Puppies) The lawsuit lists stomach and related internal bleeding, liver malfunction or failure, vomiting, diarrhea, dehydration, weight loss, seizures, bloat and kidney failure as symptoms consistently reported by dog-owners feeding their dogs Beneful, which is owned by Nestl? Purina Petcare Company. 10News Scripps sister station WCPO contacted Nestl? Purina Petcare Company for response to this suit. A spokesperson could not comment immediately as of Tuesday afternoon. The lawsuit was filed on behalf of Frank Lucido, who claimed in the suit that after purchasing a bag of Beneful for the first time in late December, all three of his dogs began falling ill with stomach and liver symptoms. He said he fed them only Beneful for less than a month. Dozer, Lucido?s English bulldog, ultimately died after beginning to show signs of internal bleeding in his stomach and lesions on his liver, the lawsuit states. Lucido?s German Shepherd Nella has shown similar symptoms and his third dog, a Labrador named Remo, has also been unwell and is currently undergoing testing, according to the suit. Lucido claims these illnesses, and similar illnesses of other dogs that have become sick and/or died after eating Beneful, were caused by toxic substances found in the food. Attorney James Young, of Morgan & Morgan out of Tampa, Florida, is one of the lawyers filing the suit, and he spoke with WCPO via Skype Tuesday afternoon. Young said, "We received hundreds of complaints. Nationally, there have been thousands of complaints about dogs who have eaten this dog food by Purina Beneful and suffered very serious side effects, including death." "The issues are pretty similar across the board," he said, "liver and kidney problems, which results in diarrhea, bloody stool, vomiting, and secondary harm." Specifically, the suit lists the automotive antifreeze component propylene glycol as a primary ingredient in Beneful?s dog food. Propylene glycol, a substance the suit says is toxic to cats and dogs, may be included in Beneful?s ingredients list because it helps retain the food?s moisture, according to the suit. Propylene glycol is a familiar ingredient in food safety cases. Fireball Whisky was recalled in Finland, Sweden, and Norway last October for what some claimed were dangerous levels of the chemical in the product. No recall of the whisky was made in the U.S. RELATED: Fireball: "All forumlas absolutely safe to drink" In an article posted to Daily Beast Tuesday, a Nestl? Purina spokesperson said, "We believe the lawsuit is without merit, and we intend to vigorously defend ourselves. This growing trend of customers bringing pets outfitted with jackets, vests, tags or badges into stores and claiming they are "service dogs" puts the safety and lives of those of us with severe, life-threatening dander allergies and asthma at risk. It also is quickly shrinking our ability to shop in and interact with our own communities as more and more places are allowing dogs into their buildings. Not only do emotional service pets expose allergy and asthma sufferers to an immediate source of dander, but one incident of an animal being brought into a store permeates microscopic dander protein in the air and on the store's products (especially books, clothing and furniture). For highly sensitive and anaphylactic people, this could mean they cannot safely enter the store and purchase products from the store again for up to 20 months. Many store owners are confused about the differences between true service dogs and "emotional support" dogs and I am writing this to help clarify the differences. Service dogs, such as dogs who assist people with blindness, are dogs who are trained to perform a specific task that a disabled person requires. Service dogs are workers, not pets, and are able to recognize the need to assist a disabled person and are trained to respond. Emotional support dogs are pets that owners bring along with them for companionship and emotional comfort. The Americans with Disabilities Act does not recognize emotional support dogs. According to their service animal policy online, "Dogs whose sole function is to provide comfort or emotional support do not qualify as service animals under the ADA." However, the Americans with Disabilities Act recognizes asthma and allergies as disabilities and in fact allows sufferers the right to reasonable accommodations at work, at school and even in some public settings as well as redress for discrimination. New Hampshire statutes also do not recognize emotional support dogs. In fact, according to NH law, "It is unlawful for any person to fit an animal with a collar, leash, vest, sign, or harness of the type which represents that the animal is a service animal ... if in fact said animal is not a service animal." Business owners and managers have the right to ask customers bearing animals two questions: 1. Is the dog a trained service dog required due to a disability? 2. What task or work has the dog been trained to do? If the dog has not been trained to perform a task or job or the dog is an "emotional support" dog, the business person has a right to ask the customer to remove the dog from the store. In my experience, I have found business managers and pet owners to be hostile when I have addressed the issue of my family having life-threatening asthma and allergies to dander. As someone who works in the field of mental health, I certainly understand the seriousness of anxiety disorders. However, Eye Movement Desensitization and Reprocessing (EMDR), relaxation breathing and Cognitive Behavioral Therapy (CBT) are the effective treatments for anxiety and trauma, not bringing pets into public buildings. Not only does bringing dogs in public buildings put the health and lives of people with dander allergies, asthma and anaphylaxis in danger, these pets can in fact increase the anxiety of people with Obsessive Compulsive Disorder (OCD) and Autism as well as children and adults with fears of dogs. The trend of flooding public places with emotional support pets could also make it difficult for disabled people with legitimate trained service animals to have access to public spaces. Ironically, while I was refilling a prescription for my asthma inhaler at a grocery store pharmacy, I encountered a woman in the store with her emotional support pet dog. I don't know what was worse about the experience, the fact that I had repeated asthma attacks the rest of the day, or the fact that the staff at the store acted with dismissive indifference - as if the dog had more of a right to be there than I did as a human being. LOS ANGELES - When former Marine Joe Bonfiglio starts thrashing in his sleep, his pit bull service dog jumps on the bed, climbs on top of him and wakes him up to end the flashback. The dog named Zen has allowed Bonfiglio, 24, who was diagnosed with post-traumatic stress disorder after returning from a five-month tour in Afghanistan, to get back to everyday activities. He can now do things such as shop at malls in Poughkeepsie, N.Y., because Zen helps calm Bonfiglio when crowds trigger a panic attack. "I used to go to bars with my friends. And war movies. I am not going to see 'American Sniper,"' he said. "It would bring me back to a place I don't want to be." Pit bulls aren't the typical choice for a service dog. They are feared, banned in hundreds of cities and blamed for sometimes deadly attacks. The Animal Farm Foundation in Dutchess County, N.Y., wants to change that stigma through a program that trains and donates rescued pit bulls to push wheelchairs or help people regain their mobility and avoid falls. The effort faces opposition from those who believe the breed is dangerous. The Assistance Dog Training Program is believed to be the only U.S. training school exclusively for service dogs that uses pit bulls from shelters, said Apryl Lea, the foundation's certified trainer. It's placed five dogs that require two years to socialize, train and acquaint with handlers. A smaller group, Pits for Patriots, trains rescued pit bulls as comfort, therapy and support dogs for veterans, police officers and firefighters but has yet to place any service dogs. Comfort dogs are pets that get a few weeks of training, while therapy animals receive at least six months of training to help calm people who haven't received a diagnosis as severe as PTSD. "Veterans and first responders can identify with pit bulls because they either have seen a lot of trauma or been through a lot of trauma," said Kelly Yearwood, co-founder Pits for Patriots in Chicago, whose group started the same year as the Animal Farm Foundation's program, in 2011. The handful of major training schools and a few smaller ones all typically breed German shepherds, Labradors and golden retrievers for the lengthy, costly process to become a service dog. Shelters nationwide watch for canine candidates for the foundation's program, which trains dogs based on Americans with Disabilities Act guidelines, Lea said. With pit bull breeds making up a huge percentage of dogs in shelters, she has to carefully decide which dogs are accepted. They must have the right build, aptitude and focus to help a person get through life with disabilities or injuries. "My job is not just to train the dog but to help the handler be a good trainer, too," she said. But the program faces pushback. "There are over 100 dog breeds that are far more suitable to perform tasks for persons with disabilities than pit bulls, especially rescued pit bulls with unknown backgrounds," said Colleen Lee, founder and president of DogsBite.org, a national group that tracks bites and works to reduce attacks through bans and other laws. Pit bulls can be unpredictable and kill or maim when they attack, she said. >From 2005 to 2014, dog attacks killed 325 people in the United States. DogsBite.org blames pit bull breeds for 62 percent of the deaths. "There is simply no need for pit bulls, rescued or otherwise, to be utilized as service dogs for people with disabilities," Lee said. Pit bulls have helped people like Bonfiglio get back to their normal lives. The former Marine has made such progress with Zen that he's now taking cybersecurity classes at Mercy College in New York. "Zen is a fantastic dog; the best thing that's happened to me since I've been home," said Bonfiglio, whose other family dogs also provide comfort. "They are all great supporters. They don't talk back, just put a smile on your face." _______________________________________________ nagdu mailing list nagdu at nfbnet.org http://nfbnet.org/mailman/listinfo/nagdu_nfbnet.org To unsubscribe, change your list options or get your account info for nagdu: http://nfbnet.org/mailman/options/nagdu_nfbnet.org/judotina48kg%40gmail.com From judotina48kg at gmail.com Fri Feb 27 13:18:58 2015 From: judotina48kg at gmail.com (Tina Thomas) Date: Fri, 27 Feb 2015 13:18:58 -0800 Subject: [Cagdu] FW: FW: Kenneth Jernigan Scholarships for National Convention 2015 [1 Attachment] Message-ID: <003601d052d3$0133e660$039bb320$@gmail.com> Braille Monitor January 2015 The Kenneth Jernigan Convention Scholarship Fund by Allen Harris >From the Editor: Allen Harris is the chairman of the Kenneth Jernigan Fund Committee and was one of the people who came up with the idea of honoring our former president and longtime leader by establishing a program to promote attendance at the national convention, where so much inspiration and learning occur. Here is Allen's announcement about the 2015 Kenneth Jernigan Convention Scholarship Fund Program: Have you always wanted to attend an NFB annual convention but have not done so because of the lack of funds? The Kenneth Jernigan Convention Scholarship Fund invites you to make an application for a scholarship grant. Perhaps this July you too can be in the Rosen Centre Hotel in Orlando, Florida, enjoying the many pleasures and learning opportunities at the largest and most important yearly convention of blind people in the world. The three biggest ticket items you need to cover when attending an NFB national convention are the roundtrip transportation, the hotel room for a week, and the food (which tends to be higher priced than at home). We attempt to award additional funds to families, but, whether a family or an individual is granted a scholarship, this fund can only help; it won't pay all the costs. Last year most of the sixty grants were in the range of $400 to $500 per individual. We recommend that you find an NFB member as your personal convention mentor, someone who has been to many national conventions and is able to share money-saving tips with you and tips on navigating the extensive agenda in the big hotel. Your mentor will help you get the most out of the amazing experience that is convention week. Who is eligible? Active NFB members, blind or sighted, who have not yet attended an NFB national convention because of lack of funding are eligible to apply. How do I apply for funding assistance? 1. You write a letter giving your contact information, and your local NFB information, your specific amount requested, and then explain why this is a good investment for the NFB. The points to cover are listed below. 2. You contact your state president in person or by phone to request his or her help in obtaining funding. Be sure to tell the president when to expect your request letter by email, and mention the deadline. 3. You (or a friend) send your letter by email to your state president. He or she must add a president's recommendation and then email both letters directly to the Kenneth Jernigan Convention Scholarship Fund Committee. Your president must forward the two letters no later than April 15, 2015. Your letter to Chairperson Allen Harris must cover these points: * Your full name, and all your telephone numbers and label them-cell phone, home, office, other person (if any). * Your mailing address and, if you have one, your email address. * Your state affiliate and state president; your chapter and chapter president, if you attend a chapter. * Your personal convention mentor and provide that person's phone number. * Your specific request: Explain how much money you need from this fund to make this trip possible for you. We suggest you consult with other members to make a rough budget for yourself. The body of your letter should answer these questions: How do you currently participate in the Federation? Why do you want to attend a national convention? What would you receive; what can you share or give? You can include in your letter to the committee any special circumstances you hope they will take into consideration. When will I be notified that I am a winner? If you are chosen to receive this scholarship, you will receive a letter with convention details which should answer most of your questions. The committee makes every effort to notify scholarship winners by May 15, but you must do several things before that to be prepared to attend if you are chosen. 1. Make your own hotel reservation. If something prevents you from attending, you can cancel the reservation. (Yes, you may arrange for roommates of your own to reduce the cost.) 2. Register online for the entire convention, including the banquet, by May 31. 3. Find someone in your chapter or affiliate who has been to many conventions and can answer your questions as a friend and advisor. 4. If you do not hear from the committee by May 15, then you did not win a grant this year. How will I receive my convention scholarship? At convention you will be given a debit card or credit card loaded with the amount of your award. The times and locations to pick up your card will be listed in the letter we sent you. The committee is not able to provide funds before the convention, so work with your chapter and state affiliate to assist you by obtaining an agreement to advance funds if you win a scholarship and to pay your treasury back after you receive your debit or credit card. What if I have more questions? For additional information email the chairman, Allen Harris, at < kjscholarships at nfb.org> or call his Baltimore, Maryland, office at (410) 659-9314, extension 2415. Above all, please use this opportunity to attend your first convention on the national level and join several thousand active Federationists in the most important meeting of the blind in the world. We hope to see you in Orlando. __._,_.___ Attachment(s) from melissa R green | View attachments on the web 1 of 1 File(s) Jernigan scholarship.docx _____ Posted by: "melissa R green" _____ Reply via web post .
