From kenvolonte at comcast.net Sun Aug 1 03:00:42 2010 From: kenvolonte at comcast.net (Ken Volonte) Date: Sun, 1 Aug 2010 03:00:42 -0700 Subject: [Cagdu] guide dog training Message-ID: <3436BEA68003408E9B885BEF6671B3F3@ken5f734aa928e> Dear Ms. Welton: I have had several guide dogs and I know what to expect from them and from the training we as blind people go through. I am writing you because of some disturbing trends which I've seen during my last class. mine was the first class to introduce reward training to reinforce physical praise. There were several dogs in class that should have washed out as guides; indeed, they would have washed out in previous years. It now seems that Guide 'Dogs for the Blind and several but not all schools are using food reward training. Let me be very clear on this next point. I have no objection to the use of food rewards when the dogs are first being trained. What I object to is the notion that suddenly, through food rewards and clicker training, any dog regardless of its core personality can and will be trained as a guide dog. When food rewards are introduced in our training, two things happen. Incorrect timing can set back a dog so that by the end of class, the dog no longer responds as a guide and has to be retrained with another blind user. The second, more insidious thing that happens is that the dog is no longer guiding us. The focus of attention has been shifted from safely crossing a busy street to getting a nugget of kibble. Now what you have is not a guide dog, but a trick dog who doesn't generalize, problem solve, or care about the work they do for us. With food pouch on hip, the public doesn't see a blind person and guide dog moving effortlessly through the town. They have the incorrect perception that we are training a dog for someone else. There's another thing that happens with food rewards and clickers. The training department comes to think that all problems have technical solutions, and those gadgets like clickers, remote controls to trigger bells mounted on poles and the like, come to substitute for our loving and working with our dogs who risk their lives for us every day. Thank you for letting me share some of my thoughts. I enjoy reading your descriptions of dog breeds. You're an honest person. In cooperation with FDA, P&G determined that some products made at this facility have the potential for salmonella contamination. As a precautionary measure, P&G is recalling all products made at this facility. Consumers who have purchased the specific dry pet foods listed should discard them. People handling dry pet food can become infected with Salmonella, especially if they have not thoroughly washed their hands after having contact with surfaces exposed to this product. Healthy people infected with Salmonella should monitor themselves for some or all of the following symptoms: nausea, vomiting, diarrhea or bloody diarrhea, abdominal cramping and fever. Rarely, Salmonella can result in more serious ailments including arterial infections, endocarditis, arthritis, muscle pain, eye irritation and urinary tract symptoms. Consumers exhibiting these signs after having contact with this product should contact their healthcare providers. Pets with Salmonella infections may have decreased appetite, fever and abdominal pain. If left untreated, pets may be lethargic and have diarrhea or bloody diarrhea, fever and vomiting. Infected but otherwise healthy pets can be carriers and infect other animals or humans. If your pet has consumed the recalled product and has these symptoms, please contact your veterinarian. Media Contact: Jason Taylor 513-622-3205 Bev VanZant, from P&G, just emailed this info. In emails we exchanged regarding last week's recalls, she told me that the FDA pretty much dictated the timing of the release. The fact that it's happening again on a Friday is of concern. It looks like the folks at P&G are doing their best to get the info out as soon as possible, but it sure would be nice if the FDA could get things together so these don't always happen on Friday (or Sunday!) evenings. FDA, what's up? Can you give us some insight on why these recalls seem to be happening on Friday evenings? Again, P&G will have people available to answer questions 9:00am to 4:00pm on Saturday and Sunday. I've just confirmed this with Bev VanZant, of P&G. Dillon" BILL NUMBER: SB 389 AMENDED BILL TEXT AMENDED IN SENATE JUNE 1, 2009 AMENDED IN SENATE MAY 5, 2009 INTRODUCED BY Senator Negrete McLeod FEBRUARY 26, 2009 An act to amend Section 144 of, and to add Sections 144.5 and 144.6 to, the Business and Professions Code, relating to professions and vocations. LEGISLATIVE COUNSEL'S DIGEST SB 389, as amended, Negrete McLeod. Professions and vocations. Existing law provides for the licensure and regulation of various professions and vocations by boards within the Department of Consumer Affairs. Existing law authorizes a board to suspend or revoke a license on various grounds, including, but not limited to, conviction of a crime, if the crime is substantially related to the qualifications, functions, or duties of the business or profession for which the license was issued. Existing law requires applicants to certain boards to provide a full set of fingerprints for the purpose of conducting criminal history record checks. This bill would make that fingerprinting requirement applicable to the Dental Board of California, the Dental Hygiene Committee of California, the Professional Fiduciaries Bureau, the Osteopathic Medical Board of California, the California Board of Podiatric Medicine, and the State Board of Chiropractic Examiners. The bill would require new applicants for a license and, and petitioners for reinstatement of a revoked, surrendered, or canceled license, to successfully complete a state and federal level criminal record information search. The bill would also require, commencing January 1, 2011, licensees who have not previously submitted fingerprints, or for whom a record of the submission of fingerprints no longer exists, to successfully complete the process necessary for a state and federal level criminal offender record information search, as specified. The bill would require licensees applying for licens e renewal to certify compliance with that requirement, as specified, and would subject a licensee to disciplinary action for making a false certification. The bill would also require a licensee to, as a condition of renewal of the license, notify the board on the license renewal form if he or she , or any member of the personnel of record of the licensee, has been convicted, as defined, of a felony or misdemeanor since his or her the last renewal, or if this is the licensee's first renewal, since the initial license was issued. The bill would provide that the Contractors' State License Board shall implement the provisions pertaining to renewal licenses on a specified schedule, after an appropriation is made for this purpose, utilizing its applicable fees. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. DILLON From: Antonette.Sorrick at dca.ca.gov Date: Tue, 3 Aug 2010 12:16:03 -0700 Subject: CCR Section 2276 (Client Instruction) To: Dear Guide Dog Users and Interested Parties: The Office of Administrative Law filed the regulatory package concerning client instruction. Illustrated below are explanations on how these changes may affect you. Schools/Clients/Instructors CCR Section 2276 The term ?client? was added to conform to international training verbiage. Training curriculum requirements were changed. Instruction was not only broken down to theory and in-harness, but the hour structure was also changed. Prior to enactment, clients training with their first guide dog were required to receive a minimum of 80 hours of instruction over a period of four weeks. Clients training with successor dogs were required to receive 40 hours of instruction over a period of two weeks. Schools were also prohibited from training neither less than 15 hours per week nor more than 25 hours per week. Effective August 21, 2010, schools may offer clients training with their first guide dog 15 hours theory and a minimum 30 hours practical in-harness instruction over a two to four week period. Clients training with successor guide dogs may receive 10 hours theory and 20 hours practical in-harness instruction. There will be no maximum number of hours of instruction imposed and, the instruction may be conducted in any appropriate venue, including, but not limited to in-residence at the school, in-home, or a combination of both. Last, subsection (c) was added to stipulate that the instruction must be individualized to the client and provided until the team achieves safe and effective guide dog mobility, until the instructor determines the team cannot satisfactorily complete instruction, or until the client discontinues services. 2276 http://weblinks.westlaw.com/result/default.aspx?cite=16CAADCS2276&db=1000937&findtype=L&fn=%5Ftop&ifm=NotSet&pbc=4BF3FCBE&rlt=CLID%5FFQRLT83781691438&rp=%2FSearch%2Fdefault%2Ewl&rs=WEBL10%2E06&service=Find&spa=CCR%2D1000&sr=TC&vr=2%2E0 The aforementioned regulatory changes were the result of a collaborative dialogue between the Board, consumers, and licensees. We look forward to a continued effort to update the Board?s statutes and regulations to give consumers choice, ensure competent and ethical guide dog instruction, and encourage a fair marketplace for guide dog schools to compete. Please give a call 415 425 5613. Thanks, Eric DRAFT RE: Oppose - Elimination of Vicious and Dangerous Animals Unit Dear Mayor Newsom: I greatly appreciate our long standing friendship and our work together. I recognize, and commend, your administration?s actions in leading the way on many issues relating to the rights of people with disabilities. I am writing today on behalf of a coalition of blind Californians and organizations that provide travel training to the blind. Accordingly, we wish to bring to your attention a risk to the public at large and the blind community specifically. The National Federation of the Blind of San Francisco writes in opposition to the elimination of the Vicious and Dangerous Animals Unit (Unit) within the San Francisco Police Department. Blind travelers who use guide dogs as their means of mobility are reliant upon the freedom to travel safely through their environment, without the interference of vicious and dangerous dogs. A dog attack is a vital issue in our community. The emotional and physical results of an attack are devastating, and can result in serious injuries to handlers and/or the death of a guide dog or force the $60,000 guide dog into early retirement. Referring these crimes to animal care & control sends the wrong message and improperly defers criminal enforcement to an inappropriate agency. Interfering with the work of a guide dog team is indeed a violation of state and federal law; and should be addressed by law enforcement. San Francisco has served as a model for other jurisdictions by having such a unit in its organization. The officers in this unit have repeatedly gone above and beyond the call of duty ? partnering with Guide Dogs for the Blind Inc. to create educational materials on the dangers of attacks on guide dogs and have repeatedly made themselves available for public speaking opportunities to educate people on the services and protections that the Vicious and Dangerous Dog Unit provides all residents and visitors of San Francisco. Information on this unit, and the protection it provides, has traveled throughout the blind community, and doubtless plays a significant role in the decisions of blind Californians to travel to San Francisco. Other organizations also in opposition to the dissolution of the Unit include: (_________) We recognize the fiscal constraints facing the police department. However, the elimination of this program compromises the safety of all guide dog users that live, work, and visit San Francisco. As our nation celebrates the 20th anniversary of the Americans with Disabilities Act, taking such a significant step backwards in the protection of the blind is unacceptable. We therefore respectfully call upon you to reverse the dangerous decision of the Police Department?s abolishment of the Unit and reinstate its officers accordingly. I formally request a meeting with you and a small group of concerned Californians to further discuss this issue. My schedule is at your disposal. Respectfully yours, ERIC HOLM, JD President NFBSF -------------- next part -------------- An HTML attachment was scrubbed... As you may know, the State of California has been without an approved State Budget since the beginning of the current fiscal year, which began on July 1, 2010. As a result, the CDSS is not authorized to issue any ADSA payments until an approved State Budget is in place. Please be assured that as soon as a State Budget is enacted any current and retroactive ADSA payments will be processed. We are sorry for any hardship this may cause and hope for a swift resolution to the current budget impasse. If you have any questions, please contact the ADSA program at (916) 657-2628 or TTY (916) 651-6248 or by e-mail at ADSAUser at dss.ca.gov. "Before I knew it, and I didn't even see it coming," Godley said, "this big black dog was on top of Diaz and was just going after him." The attack came May 26, weeks after the yellow lab graduated from the school at Guide Dogs for the Blind in San Rafael, Calif. The woman calling the attacking dog pulled it away from Diaz by the collar while also holding the collar of another large, brown dog. Godley asked for her name, but the woman walked away with the two dogs, leaving Godley n who is legally blind - alone with her injured guide. Not feeling any wounds or blood, she walked home with Diaz and called the police and the guide dog school. No one witnessed the attack and any information about the dog and owner remain unknown. Anyone with information about this attack are asked to report it to the police at 235-8278. "It was terrifying," Godley said. "My dog getting attacked in some ways felt like an attack on me because he really truly is an extension of me and my eyes, and my safe travel." Petting Diaz later at home, "I realized he was wet and I realized that it was blood. It took a while for the blood to seep through his fur where I could feel it." She took him to the vet who treated a puncture wound to his head, a tear in his ear and prescribed antibiotics. Guide dogs are trained to diffuse situations in which another dog approaches in an aggressive manner. "In this case, there was absolutely nothing before the attack," Godley said, "and those are the scary ones. From the front, the dog jumped on Diaz without any kind of notice, any kind of communication, so there was no opportunity for Diaz to show that he is very passive. That's frightening." Adding to her concern is a study which found that 22 percent of the dog attacks on guide dogs recur on the same dog, by the same attacking dog, Godley said. Even after she knew Diaz would recover physically, she didn't know if he could still be a safe guide to get her to work the next day, if they would have to return to California for retraining or if she would need another dog. "We were very fortunate," Godley said. "It could have been a lot worse." Attacks cost everyone involved "People don't realize that a dog attacking a guide dog can ruin its career," Godley said. In the worst case scenario, the dog is physically or emotionally unable to be a safe guide dog, according to a Brian Frances, a representative of Guide Dogs for the Blind. The cost of replacement is about $65,000. He cited a survey, conducted by a consumer group called Guide Dog Users Incorporated, which showed that 42 percent of guide dog users have experienced some form of attack, and 89 percent had experienced some form of interference from another dog while using their guide dog on a public walkway. "Cheryl has been lucky in that Diaz seems to have shaken off this incident," Francis said, "That's not always the case." Guide Dogs for the Blind is a non-profit organization which provides guide dogs at no cost to the owners. Replacing or retraining a service dog, however, can cost an owner through travel costs and time lost at work. Godley paid the vet bills and has spent hours on the phone with a trainer from the school, who will visit in Casper to ensure Diaz remains a safe guide dog. Their graduate assistance program covers the costs of this evaluation and Diaz doesn't require retraining on campus, saving Godley a trip. Diaz could have grown afraid of his harness, the route or even become aggressive toward other dogs. With a dog so young - he turned two June 30 n and so early in his career, it could have left a lasting negative impression. Diaz shows a heightened awareness of other dogs now, but otherwise has handled the attack well. Both dog and owner work hard to counter their feelings about the attack. Godley also feels a little more anxious around other dogs now, but overcomes it so that Diaz won't sense it and react negatively. "When we talk about teamwork between a guide dog and a blind person, it truly is," she said. "We feel each other out all the time and that kind of communication becomes very clear between us. I feel him respond through the harness so I can tell when a dog is around. I can feel it in his body and his movement." A common effect from an attack is that the guide dog becomes fearful of other dogs. "It may stop working; it may try and avoid the dog," Francis said, "and potentially put the guide dog user into some danger. It's pretty severe n those emotional impacts as far as the dog and the person are concerned." Any time period between recovery, retraining or replacement means that "the person is losing their primary mobility aid," Francis said. Sadly, he has seen physical and emotional effects necessitate several guide dogs' early retirement. "That's pretty devastating to the guide dog user as you can imagine," Francis said. Legal ramifications of an attack Metro Animal Control and Welfare manager Rick Sulzen remembers another case of a dog attacking a guide dog in about the early 1990s in Washington Park. Pet owners have a duty to make sure their animals don't pose a threat to others, according to Sulzen. "It's the neighborly thing to do," he said. "It's common sense." It's also the law. Legally, a person owning or in control of any animal who attacks a service dog is responsible for damages. Wyoming Statute 35-13-206 states that seriously injuring, killing or disabling a service animal is punishable by up to six months in prison and a $750 fine. It also includes responsibility for the veterinary or medical bills and the cost of retraining or replacing a service animal and "any other expense reasonably incurred as a result of the offense." When animals are in public spaces other than a park, they must be under verbal control of the owner, according Sulzen, meaning the dog will obey with one speaking-voice command. If the owner has to yell, the dog is not under verbal control, and should be secured by a leash no longer than ten feet in length per city ordinance. In 2009, more than 10,000 calls reported animals at large, and Metro handled about 3,000 dogs running at large. The total number of people reported bitten by an animal in 2009 was 268. According to Section 66.04.100 of the municipal code, it's unlawful for any domesticated animal to be at large. A dog is deemed "at large" if it is off the premises of the owner and the dog isn't under restraint or control of the owner. This Casper city law also states that dogs must be under physical restraint in any city park except Morad Park. Section 6.04.300 of the municipal code prohibits owning or keeping a vicious animal, or any that may manifest a disposition to bite, without having it properly restrained. When off the premises of its owner, it must be caged or muzzled and restrained by a secure collar and leash not to exceed three feet in length. Prevention is the best answer. Francis recommends all dog owners keep their fences in good order, keep dogs on a leash in public and use a muzzle if the dog has ever tried to bite or attack a person or another dog. These protective measures are repeated in state and city laws nationwide, he added, including the Casper Municipal Code. In Francis' experience, law enforcement officials often don't realize the added significance of an attack on a service dog. "There are potentially immediate safety issues for the blind person," Francis said. "Imagine a blind person in the street with their dog; their dog is now injured following a dog attack. They cannot use the dog obviously as a guide dog, the dog needs veterinary treatment. So there should be some immediate action to make sure this person's safety is OK and that any help required is rendered. This is not just a dog fight." STILL DEFIANT: Disabled vet plans to sue Big Y Supermarket over ban (video) http://google.com/ Published: Friday, August 6, 2010 01 comment(s) By Luther Turmelle, North Bureau Chief lturmelle at newhavenregister.com im Mucha of Wallingford poses with her dog, Ivy, outside the Big Y Supermarket in North Haven Thursday. In Ivy's mouth is the Notice of Trespass Mucha received after the service dog defecated in the store in late June. (Mara Lavitt/Register) Kim Mucha remains firm about what she sees as an unfair and illegal banning from Big Y Supermarket's North Haven store because her 8-year-old service dog, Ivy, accidentally messed on the floor of the produce section in June. Mucha, who lives in Wallingford, said Thursday she has hired a lawyer and is moving ahead with her plans to challenge the ban in court, despite stinging criticism and online attacks, accusing her of exploiting the situation for financial gain. Mucha says she needs Ivy, who wears a special harness, to help her with balance problems due to service-related disabilities. Big Y officials claim they were within their rights to banish Mucha and Ivy from the store because the dog was not on a leash and defecated on the floor several times, including once near where Big Y employees were making sandwiches for customers. Claire D'Amour-Daley, a spokeswoman for the Springfield, Mass., company, which has 54 locations in Connecticut and Massachusetts, was not available for comment Thursday about whether the chain has any surveillance video of the incident. But Mucha contends Big Y officials are misrepresenting what happened. "It's not about the money," said Mucha, an Air Force veteran. "This is about making people realize that people have a right to bring service dogs into stores. I'm not looking for some kind of financial settlement; I'm looking for this to go to trial so that I can fight and win." Mucha claims that banning her and Ivy from the store is a violation of the Americans with Disabilities Act. She said she would donate any money she might receive from a lawsuit to the East Coast Assistance Dogs program. The Torrington organization trained Ivy and has about 150 animals it has worked with that are in use, said Lu Picard, a founder of the group and its program director. "Kim is not that kind of person; she wants to do what's right for other people with service dogs, especially veterans," Picard said. "But I'm concerned for her. She's very fragile emotionally and some of the things that have been said about her are really horrible." East Coast Assistance Dogs has also seen some fallout from controversy, receiving some harassing e-mails, Picard said. "We're seeing a lot more people who have service dogs being denied access to stores," she said. "A lot of times it involves people with what I call invisible disabilities. But the military is increasingly recommending service dogs for our soldiers who are coming home from the Middle East with PTSD (post-traumatic stress disorder) and so we're going to see more of this, not less." To illustrate her point, Picard cited the case of Luis Montalvan, an Army veteran and the recipient of two Bronze Stars. Montalvan sued fast-food giant McDonald's for $10 million after two employees allegedly beat him in December 2008 when he and his service dog tried to enter one of its Brooklyn, N.Y., locations. Picard, who knows Montalvan, said his case was recently settled out of court. "Anyone who doesn't look disabled is being questioned," she said. "It's just a matter of people not understanding service dogs and what they do." Mucha said she is troubled that some people think she is being a troublemaker. "I apologized many times to the people in the store when it happened," Mucha said. "But some people just don't like hearing what the law is." Call Luther Turmelle at 203-789-5706. I'm glad she's taking legal action to protect her rights and I hope to see a boycott of Big Y. Unless a dog is ill, they just don't go to the bathroom wherever/whenever, especially a disciplined service animal. Sounds like Ms. Mucha should have given Ivy a little time with the fire hydrant before entering the store. Animal "accidents" happen, but any good pet owner will accept responsibility as well as the consequences. Big Y has a service to provide to the community and not just to Ms. Mucha and I think her actions are hamstringing other persons with service animals far more than helping them. Service animals are an important part of many handicapped people's lives, but having one doesn't put you above displaying common courtesy to the persons around you. Most of you people have no idea how debilitating this can be. Not many of you know anything about inner ear problems. Balance is checked in three ways. 1) by the inner ear and semicircular canals. 2) By the eyes and 3) by food in the stomach (gravity). I find that I fall when it is dark out more often than in light. So my eyes help me more to keep my balance and stay on my feet. I use a cane also to help me. I have a dog (a Lab) but not for assistance, just a good friend. I can not at all see how my dog would be able to help me with the balance problem. I need things that are hand high to hold onto. If I fell I would just fall onto my dog! A dog can not assist and help with a balance problem, they are just too small. A horse would work much better. Now if this lady has the dog as crutch for war related disorder such as PTSD then that is a different story. To say or think that the dog is for her balance trouble is obviously no so. For with a balance disorder one need something to hold onto when standing up or bending over. " Report Abuse a legal resident wrote on Aug 6, 2010 10:07 AM: " Get over yourself, lady. These amendments failed to address the concerns from the letter provided below. Please advise if the Senator is open to the exemption provided below. Thank you. April 27, 2010 The Honorable Dean Florez California State Senate State Capitol, Room 313 Sacramento, California 95814 RE: SB 250 Dear Senator Florez: The State Board of Guide Dogs for the Blind sent a letter of Oppose Unless Amended for SB 250 on May 7, 2009. An excerpt from the letter is provided below: "The State Board of Guide Dogs for the Blind opposes SB 250 unless it exempts from its provisions guide dogs in training and breeder stock from licensed guide dog schools. Guide dog schools currently pay for dog licenses and should not have to pay an additional fee for unaltered dogs for their breeding stock to produce guide dogs for the visually impaired." On August 31, 2009, amendments were made that did address an exemption for any "owner or trainer of guide dogs." It has come to our attention, however, that some of our stakeholders remain concerned that guide dog breeders are not also exempt from the licensing requirement. At their request, we have written to your office to consider adding said language to the bill upon its re-introduction this legislative session. Thank you for your consideration. Kit Malthouse has launched the public pledge against so called ?weapon? dogs this morning in Battersea Park alongside the victims of dog attacks, animal welfare organisations and park wardens. Kit Malthouse has campaigned for the last two years on greater control on ?weapon? dogs and is calling for stiffer penalties as well as extended legislation to include private land and tougher punishment for owners whose dog are dangerously out of control or cause injury. Mr Malthouse said: ?How many more innocent people and pets need to suffer horrific attacks before the government realises this needs urgent action? I am asking everyone to sign this petition and back our call to tackle the problem of snarling ?weapon? dogs in London. Anyone using a dog as a weapon should feel the full force of the law. These animals are just as dangerous as a knife or a gun and should carry the same penalties. The people hear today are proof that these dogs and their irresponsible owners are terrorising neighbourhoods across London. "Unfortunately, the current legislation doesn?t go far enough to protect people from attack, fear, intimidation and, in some cases, being mauled to death. We need tough legislation, tough enforcement and a hard-line approach to those who breed dogs for fighting and attack. The Mayor has established the Met?s Status Dogs Unit to start to deal with the problem but we need urgent Government action to make their job easier.? Barrie Hopcroft was shopping with guide dog Bailey an eight year old labrador-retriever last July when a pitbull attacked Bailey, and knocked Barrie sideways. The guide dog suffered four puncture wounds to its neck and shoulder and as Barrie tried to stop the pitbull he was bitten, causing deep hand wounds requiring 24 stitches. The dangerous dog owner then picked up his dog and jumped onto a bus and escaped. Barrie Hopcroft said: ?It was an horrific attack and the pitbull wouldn't let go. Even now, over a year later, Bailey is wary when approached by the same type of pitbull terriers." Also joining the pledge was Munever Ibrahim whose beloved Yorkshire Terrier Chippie was killed by a ?status? dog and Munever nearly lost her finger trying in vain to save her dog. Chippie died almost instantly from a broken neck and back and Mrs Ibrahim was unable to work for many weeks whilst she recovered in hospital. Munever Ibrahim said: ?I?m utterly devastated by what has happened to my dog, and I don?t think I will ever truly recover. I keep having flashbacks seeing Chippie in that dog?s mouth, I didn?t even notice at first that my hand was dangling off. Doctors thought they would have to amputate my fingers but managed to save them. When I found out my dog had died I was inconsolable. I want to do everything I can to stop this happening to someone else. People can?t use dogs to scare and intimidate ? they are literally ruining people?s lives.? Mrs Ibrahim said it was the third attack on her pet by the same dog in two years - despite repeated requests to its owner to put it on a lead. The pledge states: "Irresponsible dog ownership and dogs being used as weapons is an urgent and worrying issue that blights many neighbourhoods and parks. "I back City Hall in calling upon the government to take immediate action to deal with the problem." To join the Mayor?s Dog pledge visit www.london.gov.uk/dangerousdogs. ? He filed an injunction and a lawsuit with the city, letting him bring Sky, who is a pit bull, anywhere. "I'm more responsible of this dog than most parents are with their children," Belcher said. He is a Gulf War veteran and suffers from post traumatic stress disorder (PTSD). For the past two years, Sky has served as his service dog. "He's my medication and I have a prescription written for him," Belcher said. That prescription comes from the Denver VA Hospital. Very soon, others with disabilities will also be allowed to have pit bulls as service dogs in other cities that have bans like Denver. "That's the type of dog they've chosen to have and they should have every right with their disability to have whatever dog they feel is best suited for them," Jennifer Edwards, an attorney with the Animal Law Center, said. Tuesday afternoon, the Denver City Council discussed a ruling from the federal government that says they have to allow people with disabilities the right to have pit bulls as service dogs if they choose. "I think the consensus is: you have to do something. You can't ignore the fact that the Department of Justice has signaled that if a person with disabilities claims as their service animal a kind of dog you've banned in a municipal ordinance, that you're going to have to accommodate that person's wish to have that animal as a service animal," David Broadwell, an assistant city attorney, said. The city says it could be difficult to manage. "Clearly there has to be an observed linkage between the person's disability and the service being provided by the dog. It will either be evident or it won't," Broadwell said. The Denver City Council will discuss the issue again next week. This information was provided by Social Compassion (a 501 (c)(3) devoted to reducing the number of abandoned and euthanized animals through spay and neuter programs). http://www.socialcompassion.org/social-compassion-home.htm After communicating with Che Salinas (Senator Florez? office) and Judie Mancuso (Social Compassion) today regarding the bill, I have gathered the following information: ? Currently, Food and Agriculture Code Section 30804.5 states Whenever dog license tags are issued pursuant to this division, any such tag shall be issued for one-half or less of the fee required for a dog, if a certificate is presented from a licensed veterinarian that the dog has been spayed or neutered. ? SB 250 would make no changes to this requirement of an additional payment for an ?unaltered? dog to be licensed. This would not create any new financial burden on guide dog schools. ? Section 30804.6 would be added to include the following provision:i) The owner or custodian of the unaltered dog shall be responsible for the established costs of impoundment, which may include daily board costs, vaccination, medication, and any other diagnostic or therapeutic applications as required by this section. The owner or custodian shall comply with any additional impoundment procedures. Any fee that may be imposed pursuant to subdivision (h) shall be applicable to an owner or custodian who surrenders a dog that is subject to this section, if the owner or custodian fails to otherwise comply with applicable provisions of this section.(j) All costs and fines collected under this section and the fees collected under subdivision (i) shall be paid to the licensing agency for the purpose of defraying the cost of the implementation and enforcement of this section.(k) This section shall not be construed to prevent any local governing body from adopting requirements that are more stringent than those set forth in this section.(l) Nothing in this section shall apply to any of the following, provided the subject dog is licensed pursuant to Section 30801, Section 121690 of the Health and Safety Code, or as required by the local licensing agency:(4) Any owner or trainer of a guide dog, signal dog, or service dog, as defined in subdivisions (d), (e), and (f) of Section 365.5 of the Penal Code or Section 54.1 of the Civil Code.In this section, the only foreseeable costs to the guide dog school would be the costs of impoundment of a breeder dog, or guide dog in training. Depending on the occurrence of impoundment of said types of dogs, this may or may not be an issue. Reducing unaltered license fees for guide dogs in training or breeder dogs would require new legislation. The Board will discuss this bill at our October 25, 2010 meeting. Pit bull service dog owners make progress with City Council Peter Marcus, DDN Staff Writer Thursday, August 26, 2010 SERVICE DOG? - To Glenn Belcher, an Operation Desert Storm veteran, his pit bull, Sky, absolutely is a service dog. http://www.thedenverdailynews.com/article.php?aID=9737 Operation Desert Storm veteran Glenn Belcher suffers from posttraumatic stress disorder. His 3-year-old pit bull, Sky, is his only saving grace. But Denver animal control officials won't let Belcher keep his pit bull because of a 20-year-old city ban on the breed. Never mind that Sky is considered a service dog, protected by the Americans with Disabilities Act. Animal Control Director Doug Kelley simply couldn't approve Sky for use in the city because Sky is of a banned breed, considered by most on City Council to be vicious and a danger to the city. Help, however, may be coming to disabled Denverites like Belcher. A City Council committee on Tuesday moved forward with a change to the city's 20-year-old ban on the breed that would allow people with disabilities to own pit bulls that are considered service dogs. Belcher relies on Sky. He shares his horror stories with his buddy so that he doesn't have to burden his friends and family with the pain. When Belcher suffers from night terrors, Sky sits on his chest to keep him from panicking out of control. Sometimes Sky wakes Belcher up out of the terrors and eases his trauma with a lick to the face. "There's no such thing as a bad dog, but there's such a thing as bad owners," explains Belcher. "That's what happened. This poor breed has just been side-railed into oblivion, and I think it's time for the public to understand that it's not the dogs." When Belcher was blocked by animal control from having his service pit bill in Denver, he took the case to the Wheat Ridge-based Animal Law Center. Attorneys planned on filing with a federal court for an injunction preventing the city from blocking pit bulls as service dogs. But in March, both Denver and Aurora - which also bans pit bulls - signed a joint stipulation stating that they wouldn't go after any pit bulls that are considered service dogs. Attorney Jennifer Edwards isn't resting quite yet. She has filed a federal lawsuit challenging both Denver's and Aurora's pit bull bans, arguing that the Americans with Disabilities Act prohibits municipalities from using breed-specific legislation to ban any service dog. Three plaintiffs are named, including Belcher. The federal law is clear in that it preempts any municipal breed-specific ban in cases where the animal has been designated as a service dog, said Edwards. City attorneys agree. The Animal Law Center's lawsuit also challenges Denver's prohibition against transporting pit bulls through Denver. City Council members heard from city attorneys on Tuesday that they need to update the city's pit bull ban to lift transport restrictions on pit bull owners who travel through Denver. A state court actually ruled in 2004 that the city had no right to prohibit transport of pit bulls through the city. But in over five years, city officials never updated its law to comply with the court's order. "It's pretty offensive that this has been on the books this way for this long in complete violation of the ADA, in complete violation of our Constitutionally protected rights, and it took a lawsuit from the Animal Law Center to open their eyes," said Edwards. The proposed ordinance change passed out of the Health, Safety, Education and Services Committee on Tuesday and is likely to be heard by the full City Council on Sept. 13. City Council members appeared reluctant to back the ordinance change, but felt their hands were tied by federal law. Councilwoman Carol Boigon, who has a disability herself and says she is a proponent of the Americans with Disabilities Act, said she is concerned that the ordinance change will lead to an abuse of the system and a sort of back door to legalizing pit bulls. "I'm thinking of all of the drug houses that I have worked on over the last seven years, and a couple of them have people who have become paraplegics in bad drug deals, but were still dealing out of their house, and they had tough dogs," said Boigon. "Was that a service dog? Well, I don't know, but those certainly were legitimately handicapped people. I think we're going to be in a world of hurt down the road on this." Animal Control Director Kelley acknowledged that the city has no separate licensing process for service dogs. In other words, anyone can walk in to claim their dog is a service dog, and animal control officers are not allowed to ask specific questions about the person's disability because of protections afforded under the Americans with Disabilities Act. City attorneys acknowledged that the only way for animal control officers to prove that a person is legitimately using a service dog would be to follow-up with an investigation. But officials say there simply are no resources to allow for those investigations. Councilman Doug Linkhart suggested that Kelley and his department develop a separate licensing process for service animals, as well as a test or survey to accompany the application. But in the meantime, concern - or joy depending on which side of the fence you stand on - is being raised that the ordinance change is leading to a legalization of pit bulls in the City of Denver. Councilwoman Carla Madison - an opponent of the city's pit bull ban who is attempting to garner support for a bill that would allow pit bulls if they are specially licensed by the city - said it is ridiculous for the Council to be enacting piecemeal changes to the city's pit bull ban. "I just think that this opens kind of a Pandora's box," she told her colleagues. "You have to observe the dog. Who's going to do that observation? We don't have that many animal control officers, and they have enough to do as it is." "Maybe we need to re-look at our pit bull ban and see if there's some way we can help close that gap . maybe put in place a dangerous dog act, just look at it differently," Madison continued. The lawsuit by the Animal Law Center isn't the only lawsuit Denver is facing. There are at least eight individuals who have or are currently pursuing or considering lawsuits against the city. The most prominent case is one filed in 2007 by pit bull advocate Sonya Dias. The city is spending thousands of dollars defending itself against the lawsuit. Dias was forced to sell her home in Denver to save her pit bull Gryffindor. She hopes the continued pressure will lead to a repeal of the ban. "Any sort of societal change takes time, and thank God we're moving toward more wiser laws and maybe a little compassion thrown in there as well," said Dias. "I think it's going to change, no matter what. What we're doing, and what the ADA-oriented lawsuit has done is just pushing that to make it happen a little faster." _______________________________________________ nagdu mailing list nagdu at nfbnet.org http://www.nfbnet.org/mailman/listinfo/nagdu_nfbnet.org To unsubscribe, change your list options or get your account info for nagdu: http://www.nfbnet.org/mailman/options/nagdu_nfbnet.org/tinadt%40sbcglobal.ne t From tinadt at sbcglobal.net Mon Aug 30 11:12:30 2010 From: tinadt at sbcglobal.net (Tina Thomas) Date: Mon, 30 Aug 2010 11:12:30 -0700 Subject: [Cagdu] FW: Legislative Update Message-ID: <004001cb486e$e9fee670$bdfcb350$@net> Subject: RE: Legislative Update State Board of Guide Dogs for the Blind Legislative Committee Update SB 1491 (Senate Business Professions and Economic Development Committee) - In-Home Training http://info.sen.ca.gov/pub/09-10/bill/sen/sb_1451-1500/sb_1491_bill_20100616 _amended_asm_v98.html If your organization is in support of SB 1491, please send a letter to Governor Arnold Schwarzenegger encouraging him to sign the bill. Staff Recommendation: Support April 27, 2010 The Honorable Dean Florez California State Senate State Capitol, Room 313 Sacramento, California 95814 RE: SB 250 Dear Senator Florez: The State Board of Guide Dogs for the Blind sent a letter of Oppose Unless Amended for SB 250 on May 7, 2009. An excerpt from the letter is provided below: ?The State Board of Guide Dogs for the Blind opposes SB 250 unless it exempts from its provisions guide dogs in training and breeder stock from licensed guide dog schools. Guide dog schools currently pay for dog licenses and should not have to pay an additional fee for unaltered dogs for their breeding stock to produce guide dogs for the visually impaired.? On August 31, 2009, amendments were made that did address an exemption for any ?owner or trainer of guide dogs.? It has come to our attention, however, that some of our stakeholders remain concerned that guide dog breeders are not also exempt from the licensing requirement. At their request, we have written to your office to consider adding said language to the bill upon its re-introduction this legislative session. Thank you for your consideration. Should you have any questions regarding this issue, please feel free to contact me at (916) 574-7825. Thank you. Sincerely, Thomas B. Scott Thomas B.
