I appreciate her helping with it. I then changed the letter, due to the fact, that I felt it needed to be simplified. So, Attached is the letter. I have called Padilla's office, for I wanted to deliver it personally, for his local office is in Van Nuys. They can not tell me, when he will be in the district, in other words, I can not meet with my own Senator. I have spoken with the Sacramento office, and the person handling sb 475 is not available by phone at this time. I urge all of you, to call the Sacramento office, ask for Mr. Mortan, and let him know of your opposition. The number to call, is 916-651-4020. I know it was discussed at our regular monthly meeting, and I appointed Shannon D. as chair. I also realize that it was posted on our CAGDU list serve so that if anyone had any questions they could either attend the meeting or make a phone call to anyone of us (on the board or the committee). I want to thank everyone for their time, efforts and hard work, and I'm sure it will be worth it. However, there seems to be some confusion between committee members and others; therefore, I would like to call a meeting on Sunday, April 5. If Shannon ( committee chair) would please set a time and contact President Willows to make sure the conference line will be available for us, it would be appreciated . Also, please post the meeting information on the CAGDU list serve. Again, I urge for all to attend, we want everyone's voices heard, and we want to be clear on this issue. If CAGDU of the NFBC is going to take steps on issues concerning legal matters, it must be one clear united action. Thank you for caring, Juliet Cody CAGDU President -------------- next part -------------- An HTML attachment was scrubbed... The following thoughts represent my views on the guide dog board and its function. The society we live in now is a more mobile one. People travel about all the time for jobs, for increased opportunities, for a change in their individual needs and preferences. I happen to live in California, but I should be able to go to a guide dog school of my choice safe in the knowledge that my chosen school can provide me with follow up services if needed. The position of the guide dog board is at odds with this because the board requires all schools to obtain licensure in California. Every school has its own specialty which might dictate a desire to go there. For example, Pilot dogs was, for a long time, the only school that was comfortable with guide dogs using escalators. GDB dogs have the edge in terms of soundness and consistency. Fidelco uses German Shepherds, and so on. All of these schools know how to train guide dogs, and the law should recognize this and not put encumbrances in the way of any student making any choice. Now we come to the matter of trainers who will train a pet dog to be a guide dog for a small fee of, say $1,000.00 a month. Suppose I want to train my pet Poodle to be a guide and go to one of these unscrupulous trainers. What guarantee do I have that this trainer knows what is expected of a guide dog? What protection do I or the public have under the law? If push came to shove, none at all. I have no problem with a licensing body or with supporting that body. I have two problems with the California State Guide Dog Board. First, board members are appointed by the governor and this appointment can be secured by a big contribution. People on the board don't necessarily have to know anything about guide dogs or their function. Second, the board presumes to regulate schools outside of California, and that's the focus of this whole business with 475. Cagdu may have inadvertently caused this problem by inviting members of the board to our seminar last year, and it's up to us to fix it. April 3, 2009 Iowans who are blind could soon get government assistance to help pay for the annual care of their guide dogs. House File 488 directs state officials to request that the federal government pay for up to $500 in care each year through medical assistance home and community-based services waivers. The purchase of a service animal, however, would not be covered, said Sen. Herman Quirmbach, D-Ames. The Iowa Senate approved the bill 50-0. It now goes to the governor. http://www.desmoine sregister.com/article/20090403/NEWS10/90402069/1001/NEWS __._,_.___ Messages in this topic (1) Reply (via web post) | Start a new topic Messages For guide dog handlers assisting guide dog handlers with advocacy/education-- visit: www.gdui.org or www.nfb-nagdu.org MARKETPLACE _____ From kitchen basics to easy recipes - join the Group from Kraft Foods Yahoo! This puts people who have received their dogs from an out of state school at a disadvantage because follow up services can't be provided in person. With this power grab, the Guide Dog Board has outlived its usefulness. SB 475 is a bill that if passed would increase the amount schools would pay to the board annually. Separate from the issue of SB 475 is the issue of whether the board is overstepping its bounds by requiring out of state schools to comply with licensing requirements that deny follow-up services to Californians who choose to train with out-of-state schools. Out-of-state schools who do not become licensed by the California board are not supposed to provide follow-up training or services within the state of California. This issue came up last year when I spoke about my training experience at the August 23 seminar in Oakland. So there are two issues we need to work on right now. One is the SB 475 issue, in which the board would like to ask for more money from not-for-profit schools who conduct guide dog training. Is it reasonable that not-for-profits have to pay 5% of their annual income to the Board? What does the Board do to deserve this money? Do you think the people who donated their money to the guide dog schools intended it to be spent on payments to a board that denies or limits choices of Californians to training? The board was created in 1947 to help protect blind veterans. I think blind people now are a long way from where they were in 1947. Anyway, SB 475 is the issue we all should write individual letters to Senator Padilla about. We will send a letter as CAGDU once we have the new letterhead. The second issue we have to work on is what to do about the board altogether. The legislation creating the board sunsets in 2010 or 2011. So this is a good time to be working on the resolution to put this board to bed. I'm working on gathering more information for the resolution. I previously put it altogether and have to dig it up again. SHANNON L. When this happened, and to generate enough revenue for the Board to carry out its statutory mission, guide dog instructor renewal fees went from $5 per year to $100 per year and guide dog school annual renewal fees were set at .4% of the schools total expenses. "Expenses" are those dollars spent by the school to provide training, not their total revenues. * Today, the Board is faced with budget challenges brought on by a $30,000 decrease in funds from one school and the prospects of less funds being generated from the guide dog schools due to the failing economy. These factors will cause the Guide Dog Fund to be depleted and go into negative numbers by fiscal year 2012-13. Due to this projected shortfall, the Board is pursuing legislation that would by statute change the ceiling the Board could charge guide dog schools, the major source of the Board's funding, from the current .4% to .5% of total expenses. Our proposed bill then allows us to set the actual fee in regulation. We would immediately set the fee at .425%. This slight increase will make up for the loss the Board incurred and help it fulfill its mission into the future. (Note: Instructor annual renewal fees will not change). * This bill with its proposed adjustment of the fee formula is by no means a way to expand the Board; it simply allows the Board to sustain its current level of services and remain within the Department of Consumer Affairs. * If the bill does not pass, there is a possibility the Board would move out of the Department of Consumer Affairs and into the Department of Rehabilitation. This move would mean that the Board would be governed by state funds and be susceptible to general fund cuts in DOR's budget which is already reported to have little or no flexibility. Dillon) Date: Mon, 6 Apr 2009 15:05:23 -0700 Subject: [Cagdu] Brief History of the Board Message-ID: Hi CAGDU Community and Resolution Committee: Below please find the brief history of the Board. I copied it from their web site. It discusses "scandalous activities that historically characterized [the guide dog] field." I think this is a good place to start working on our resolution. Brief History of the Guide Dog Board In the 1940s, before the California State Board of Guide Dogs for the Blind was created to maintain professional standards of training, the guide dog field suffered from many of the same problems the service dog industry is experiencing today. Besides considerable public confusion as to the role and function of guide dogs in public places, a long list of scandalous activities historically characterized our field. Providing dogs with no training; raising funds with no plans to produce trained dogs; selling dogs; accepting people for training and not providing any; and selling unauthorized certification papers were significant features of many of the "guide dogs schools" operating in California. While dogs had been used to assist blind people for thousands of years, the aftermath of the unregulated Industrial Revolution and horrible wounds of World War II increased the number of persons who were visually impaired. With no minimum standards set for schools,it was possible for any person to start a guide dog program. By the 1940s, programs of varying quality and competence were emerging throughout the country, most of them in California. Many people and organizations that provided services to the blind felt that the growth of unregulated operations was potentially so dangerous to consumers that something had to be done. A small group of blind people, the California Council of the Blind, and the editors of the Pasadena Star-News joined with highly supportive legislators to lay the groundwork for an agency that would ensure that blind people would receive competent instruction with properly trained dogs. It would also ensure that funds raised for guide dogs would be spent properly and that the public would be educated as to the services a dog provides. The Guide Dog Act that created the Board became law in 1947. At first there were close to 20 guide dog operations; after the Board was established, only two were able to qualify for licenses. They still exist today: Guide Dogs for the Blind in San Rafael and Guide Dogs of America in Sylmar. (The third California school, Guide Dogs of the Desert was licensed in 1972). Like many states, California controls the licensing and regulation of specific services and agencies such as dentists, architects, engineers and contractors. However California is the only state that requires mandatory licensing of guide dog schools and instructors. The Guide Dog Board believes that minimum standards and licensing expand opportunities for guide dog users through better public education and law enforcement. Back to Top | SHANNON L. There are excellent Guide Dog schools elsewhere than in California and they have trainers that are extremely knowledgeable and even lecture. I also emphasized that the Board is taking money based on expenses that the schools have and that these funds can therefore not be spent on training or guide dog teams (or the development thereof). I told him that the donors are most likely not aware of the fact that some of the schools expenses are licensing fees for California. The Board should be forced to disclose that fact to donors and the Board seems to prevent schools from providing services rather than rendering them. If a school sends their trainer to California, the trainer and school spend money in California and support the economy in numerous ways. Why should they be prevented from providing services because of the Board and what has the Board really done for us? Why should there be a fee increase to sustain a Board that lost its purpose? You may wish to encourage them to call their local airports to advocate for appropriate relieving areas. Thanks! Theresa Duncan ------------ IAADP Airport Service Animal Relief Areas Dear IAADP Members and Supporters, According to the latest rules established by the U.S. Department of Transportation, all U.S. airports are required to have installed service animal relief areas by May 13, 2009. Since DOT is not in a position to enforce this requirement, it is up to us to help make air travel with assistance dogs as safe, convenient and comfortable as possible. The following article which will appear in Partners' Forum provides information about the new rule, and how to go about working with airlines and airports to ensure compliance as soon as possible. For many of us who travel with canine assistants, this new requirement will make air travel a less stressful experience! Ed Eames, Ph.D., President *ARTICLE START* I'm Relieved That You Can Now Relieve! by Toni and Ed Eames During a long layover in Salt Lake City airport, we met the perfect escort! He listened and responded to our needs, described the surroundings as we trudged through the airport, and, best of all, knew a good grassy spot near the parking garage where our guide dogs, Keebler and Latrell, were able to have a relief break! Fortunately, the security agents were familiar with screening disabled people accompanied by assistance dogs and the whole process took less than half an hour. We made our connecting flight without a problem. Wouldn't it be wonderful if every transfer at an airport could be as stress free as this? That dream can become a reality if the new rules developed by the U.S. Department of Transportation (DOT) are implemented. One requirement is that airlines create service animal relief areas at all U.S. airports by May 13, 2009. In addition, escort service, known as meet-and-assist personnel, will be required to show us to these areas and escort us to our next gate or destination, if this service is requested. To convert these rules set forth in 2008 into actuality requires a cooperative effort on the part of assistance dog training programs and those of us partnered with assistance dogs. The Coalition of Assistance Dog Organizations, which includes IAADP, has taken on this advocacy outreach effort for the 50 most traveled airports in the United States. With only a short time to go before the May 13 deadline, if you want to get involved, we recommend contacting your local airport operators and airline representatives to make sure the relief areas are adequate and accessible. In addition, it is important to make a case for installing relief areas within the secured perimeter to avoid the need to go through security after providing a relief break for your dog. IAADP recommends: 1. Contact your closest airport and ask whether the mandated relief areas have been installed. If the answer is no, then find out when that will be done and who is responsible for the installation. 2. The probability is nothing has been done and it is important for you to inform the airlines and airport management they have a very short time to be in compliance with DOT's New Rule. Offer your expertise in developing an accessible and convenient facility. Also, stress the point that escort providers and other staff need to know where the relief areas are located. 3. Make a case for placing the relief area within the secured perimeter. Reasons for this are: A. It will be more convenient for travelers with disabilities accompanied by assistance dogs not to have to go through security after taking their dogs to the relief area. The disabled community constitutes a significant segment of those who travel by air and airlines should be providing greater service to us. The need to take your canine assistant to a relief area outside the terminal can result in missed flights and major inconvenience and discomfort for you. B. Having to go through security not only places a burden on the disabled passenger but on the security check operation, as well. Many partners accompanied by assistance dogs must go through an intensive search because the assistance dog equipment sets off the alarm system requiring a time consuming hands on search. This not only delays us, but also causes delays to other passengers and takes the time of TSA staff. By providing the relief area within the secured perimeter, this unnecessary use of security checking time and personnel can be avoided. C. Since the escort service is required to accompany the disabled person/assistance dog team to and from the relief area, their time commitment would be significantly decreased If the relief area were within the secured perimeter. This would decrease the cost to airlines. 4. It is Important to emphasize the need for you to be involved in the actual design and placement of the relief area to make it fully accessible and convenient for disabled passengers. For specific suggestions, see the model letter below. When we landed at Canada's Prince Edward Island airport several years ago, Toni's partner Escort pointed to a patch of grass on the tarmac adjacent to the terminal door. Established to enhance the decor of the airport, the grass patch conveniently served as a unique relief area! It would be wonderful if all airports had a similar approach. We have the opportunity to make this happen! Although the law may be on our side, it is important to engage airlines and airport representatives in a positive way. Airports have not been designed for us and our assistance dogs, so it is important to move toward a mutually satisfactory way of complying with this new mandate. ***MODEL LETTER*** On first approaching airline staff or airport operators, we suggest the following letter be sent: *START OF MODEL LETTER* Dear Airline Station Manager, The Department of Transportation has set forth new rules requiring the installation of service animal relief areas at all U.S. airports ( see the relevant paragraph from the Final Rule below my signature ) As one who frequently travels through your airport accompanied by my assistance dog [ put in your dog's name ], and as an IAADP member, I would like to work with you on implementing this mandate. The Coalition of Assistance Dog Organizations, representing the International Association of Assistance Dog Partners (IAADP), Guide Dog Users Inc. (GDUI), Assistance Dogs International North America (ADI NA) and the Council of U.S. Dog Guide Schools (CUSDGS), has shared the following GUIDELINES with the U.S. Department of Transportation Guidelines for Service Animal Relief Areas at Airports 1. Service animal relief areas should be established within the secured perimeter. 2. The location of service animal relief areas should be negotiated between airlines, airport operators, assistance dog training programs and assistance dog partners. Representatives of TSA should be asked to participate in these discussions. 3. A minimum area of 10 feet by 10 feet should be set aside for each relief area. If space permits a larger area should be designated. 4. Grass or other natural surfaces are preferred. Additional surfaces may be wood chips or gravel. 5. Every service animal relief area must be accessible for physically disabled individuals using wheelchairs or other mobility devices. 6. The service animal relief area must be maintained by airlines and/or airport operators. 7. All service animal relief areas should have bags for pick up, pooper scoopers and trash receptacles. 8. Service animal relief areas should be fenced in with gates wide enough to provide wheelchair access. 9. Escort service staff must be trained about these requirements and notified of the mandate to provide escort service to and from the service animal relief area for disabled passengers accompanied by assistance dogs. 10. Other airline staff, such as Complaint Resolution Officials, must be trained about these requirements and know the location of designated service animal relief areas. I would like to assist you in any way possible. Please contact me at [ include your phone number, address and email address ] [ Sign your Name and Date the Letter] Below is the language used in the final rule published in the Federal Register Part II Department of Transportation 14 CFR Part 382 Nondiscrimination on the Basis of Disability in Air Travel; Final Rule Page 39 382.51 Paragraph only: One new requirement at U.S. airports is to provide, in cooperation with the airport operator, animal relief areas for service animals that accompany passengers who are departing, arriving, or connecting at the facility. *END OF MODEL LETTER* To Unsubscribe, contact database at iaadp.org. It is between the west and east terminals, on the baggage pick-up level. It is equally inconvenient from either terminal. When I was at LAX in December '08 and January '09, none of the staffers could tell me if they had a relief area. Luckily, there is quite a bit of landscaping across the street from baggage pick-up.. My name is Ken Metz, and I am the chairperson for our local Access Para Transit system here in Los Angeles County. The reason I'm sending this email on such a wide basis is because I'd like to get responses from all over the country pertaining to the following: Approximately 10 years ago, a few Access riders in the Los Angeles area filed a class action lawsuit because a number of the contracted provider's drivers refused to take qualified riders with their service animals. This lawsuit was successful, and I must say that few incidents occur these days with drivers refusing to take our guide dogs or any other service animals. Another result of this lawsuit was that Access Para Transit would organize a "service animal" sub-committee which would look at complaints and discuss ongoing issues pertaining to riders who use service animals. One of the major problems we have discussed for most of those nine years had to do with service animals slipping and sliding in the wheelchair vans when drivers either made defensive maneuvers during heavy traffic, or in some cases just had one foot on the accelerator and one on the brake. We in the Los Angeles area know of two or three guide dogs that needed to be replaced for this type of situation, slipping and sliding, and even being thrown into the wheelchair ramp on the right side of the van. Also, the flooring is so thin that a good amount of heat comes up from the undercarriage of these vans. We have been asking our Para Transit company to purchase floor mats that would stay in the back of the vans only to be placed down if they knew they were going to have a service animal in their van. Our reason for not wanting to carry these mats themselves is due to the fact that the van floors are often dirty, and we don't want to carry someone else's dirt with us especially if we are going somewhere dressed up. In November, 2007, the Community Advisory Committee (CAC) listened to our story and voted to bring this issue to the Access Board for approval to pay for two mats in each van and/or bubble-top bus, all having these slippery floors. The Service Animal sub-committee then went out and purchased a few mats to show to the Access Services people and their risk management team. When nothing was done by the end of 2008, we again approached the Access team about the November, 2007 vote, and they said that now they were sending this to a TPAC (Transportation Professionals Advisory Team) committee to validate the need for the mats. This committee has no Para Transit riders, one person in a wheelchair, and all driving their own vehicles. These folks are in the hierarchy of their respective transportation companies in the Los Angeles and Orange Counties and claim to have all kinds of expertise on all transportation requirements. They have now submitted their report to Access Services Inc and have unanimously stated and voted that there is no validity to our complaints of service animals sliding and being physically and/or mentally injured. The TPAC stated that the mats would perhaps cause problems with other riders tripping on them, or wheelchair riders having difficulty with them. We have only asked that these mats be placed down when the driver knew that a passenger was going to board the van or bubble-top bus with a service animal, and then put it away in the back when they disembarked. For the almost ten years that our service animal sub-committee has been meeting, we have complained numerous times about these situations, and both Access and the TPAC stated that there were no complaints of this nature, completely bogus. I would very much appreciate any of you who use service animals (guide dogs) out of the Los Angeles area to please write me if you have had similar incidents that I have brought up so that I can present a compilation of blind folks having similar issues so that Access can't say that this does not occur anywhere else in the country. Please give me any solutions if you've found resolution to these issues. For those of you in the Los Angeles area who can attend the Community Advisory Committee this Tuesday from 12:30 - 2:30 p.m. to give public comment, I would appreciate it very much. The address of the building is 706 W. 6th Street, 6th Floor Conference Room, Los Angeles. Either your written or oral testimony (three minute maximum for speaking) will be most appreciated. If you respond to me directly, I will print and compile your stories and turn them in this Tuesday. If we don't get this situation overturned, we will then look for someone to represent us for either structured negotiations or an additional class action lawsuit. Your help is badly needed and very much appreciated. __._,_.___ Messages in this topic (1) Reply (via web post) | Start a new topic Messages | Files | Photos | Links | Database | Polls | Members | Calendar MARKETPLACE _____ From kitchen basics to easy recipes - join the Group from Kraft Foods _____ I make $350/day online. I just got a message that the little flyer inviting guide dog users and puppy raisers to join our march on May 16th couldn't be delivered because Guide Dogs for the Blind does not accept messages from networks. We're going to talk about this tonight you can be sure of that. We have all worked too hard for our efforts to be dismissed like this. How many times have we gone to Fun Days or Guide Dog luncheons? How many speeches have we made on behalf of Guide dog schools? For GDB to dismiss us out of hand is wrong. I have no illusions that this was a decision made by Teresa Duncan or any other individual. This is at the corporate level, and it assumes an unwarranted control over our lives that I shall not accept. All we asked for was that GDB post the announcement on the ezine. We didn't ask for their help in conducting this march nor did we ask for their seal of approval. What we got was the shaft. Oh we will talk about this. As the field services rep for this area, we could use your help in distributing the following information. The California Association of Guide Dog Users, (Cagdu) is conducting the "We Are Here March" on May 16th from 9:am--11:am. This march is to demonstrate to the public that guide dogs are an effective way for blind people to get where we need to go safely and quickly. There will be a $20.00 registration fee payable at the start of the march. The contact person in Stockton is Ken Volonte, 209-464-6766. Email: kenvolonte at comcast.net. There is also a march in San Diego. Contact person for that march is Juliet Cody. Phone: 760-480-1265. Email: julietcody at cox.net. We invite guide dog users, puppy raisers and well wishers to come and join the fun. We'll see you on the 16th. Please contact us so we'll know how many marchers we'll have. t From kenvolonte at comcast.net Tue Apr 28 21:08:57 2009 From: kenvolonte at comcast.net (Ken Volonte) Date: Tue, 28 Apr 2009 21:08:57 -0700 Subject: [Cagdu] we are here march Message-ID: <06031766A8784E629843858AAD3160D9@ken5f734aa928e> Hi list.
