"For that wall to go up, I was humiliated and embarrassed,-" said Kornman, who is legally blind and works as an outreach specialist with The Seeing Eye, a Morris Township organization that trains guide dogs for people who are blind or visually impaired. Kornman explained that federal law allows him access to public places with his dog, but he was still denied entry, something the Seeing Eye organization decided to address through a public service announcement taped Sunday in Morristown. The cast and crew of more than 30 people gathered at Sebastian's Steakhouse on Elm Street for a daylong shoot produced to enhance the public's knowledge of access for service dogs accompanying blind owners. "We didn't want it to be dry," said Theresa Davenport, the director of communications for The See ing Eye. "With YouTube and everything else, people are so used to seeing great video we wanted it to be something unique." The organization got help producing the commercial from the North American Precis Syndicate, which chose to distribute a public service announcement for the group for free as part of the syndicate's 50th anniversary celebration. A local taxi cab company and restaurant also donated their services. The commercial is expected to be completed next week, with distribution planned to more than 1,000 television stations across the nation. Once completed, the commercial may also be viewed at The Seeing Eye's website -- HYPERLINK "http://www.seeing"http://www.seeing eye.org The commercial's narrative features Kathy Murray, a blind Rockaway Borough resident who enters the restaurant with an actor playing her husband. They are seated near several distracting patrons, including people talking loudly on their cell phones, a woman sticking gum under her seat and a little boy bothering his older sister and twirling a pepper grinder. A waitress approaches Murray, and tells her she dropped her coat on the floor. The waitress later realizes the coat is Winnie, the golden retriever who guides Murray. The waitress walks over to the maitre'd, asking him if he knew the dog was in the restaurant. He tells the waitress to let him know if anyone bothers her. As Murray, her husband and the dog later leave the restaurant and step into a taxi, information about the federal law allowing service dogs access to public places appears on the screen. The commercial highlights an issue blind people with service dogs experience, at restaurants, hotels, apartment buildings, in taxicabs and elsewhere. While some people may object to the presence of dogs for health or religious reasons, the Americans with Disabilities Act supersedes personal objections. The law allows a civil complaint to be filed, with the person denied access having the right to file a report with police and to pursue damages in court. Despite the law, The Seeing Eye still receives an average of 20 inquiries each month from people who have been denied access be cause of their guide dog, Davenport said. "Those are only the ones we hear of," she said. Robert E. Williams III may be reached at HYPERLINK "mailto:rwilliams%40starledger.com"rwilliams at starledge-r.com or (973) 539-7910. Pasted below is a letter from Debbie Stein, chair of NFB's Quiet Car committee. She is conducting a survey of both sighted and blind people who have experienced accidents or near accidents involving vehicles they could not hear. Her contact info is at the bottom of this message. Please help if you can. --- Open Letter to Guide Dog Users Hello, As you probably know, many people in both the blind and sighted communities are increasingly concerned about the hazard posed by silently-operating hybrid and electric vehicles, as well as very quiet cars with standard combustion engines. Because it is extremely difficult to hear these vehicles under normal traffic conditions, cyclists and pedestrians are often dangerously unaware of their presence and movements. I chair the Committee on Automobile and Pedestrian Safety (CAPS--also known as the Quiet Cars Committee) of the National Federation of the Blind. We are gathering information from people who have had accidents or near accidents involving vehicles they could not hear. If as a pedestrian or cyclist you have been in an accident involving a quiet car, or if you have had a frightening close call, please contact me. I am conducting a short survey with people who have had quiet-car incidents, and I would like very much to collect information about what happened to you. The survey questions take ten to fifteen minutes. The information you share will help us build a stronger case for the need for a solution to the quiet-car problem. Thank you in advance for your help! The symptom list, located at HYPERLINK "http://www.DogChannel.com/medical"http://www.DogChann-el.com/medical was compiled by Dog Fancy's "Ask the Vet" expert Karla Rugh, DVM, Ph.D. of Rocheport, Missouri. The section contains the 40 most common signs of a sick dog, from appetite changes to yellow eyes, along with possible causes and treatment options. "We are thrilled to be able to offer this feature to DogChannel visitors. Every dog owner has been through the nightmare of having something happen to their dog, but not knowing whether it requires a trip to an emergency vet hospital, or just a watch-and-wait response," explains Dog Fancy and DogChannel Editor Susan Chaney. "The Medical Conditions section lets them easily decide how to handle any of 40 common problems dogs can have." Dr. Rugh also offers her expertise in the Dog Skin Conditions area ( HYPERLINK "http://www.DogChannel.com/skin"http://www.DogChann-el.com/skin) where visitors can match their dog's skin condition to photographs and read a description of the skin problem. "I believe this to be the most comprehensive dog diagnostics tool written by a veterinarian anywhere on the Internet," says Michelle Williams, Bowtie, Inc.'s Internet Marketing Director. Dr. Rugh is the author of What About Labrador Retrievers? (Howell, 2003) and English Setters: Everything About Purchase, Care, Nutrition, and Behavior (Barron's, 2000). APARTMENT OWNER, MANAGING AGENT AGAINST PERSONS WITH DISABILITIES WASHINGTON - The Justice Department today announced that the former owner and managing agent of the Barrcrest Manor Apartments in Lancaster, Pa., have agreed to pay up to $60,500 to resolve a DOJ lawsuit alleging discrimination against persons with disabilities. According to the complaint, which was filed in the U.S. District Court for the Eastern District of Pennsylvania, the defendants refused to rent an apartment to a man who is visually impaired and uses a guide dog. The lawsuit was a result of Operation Home Sweet Home. This fair housing testing program employs individuals who pose as renters for purposes of gathering information about possible discriminatory practices in the rental of apartments. "I am pleased that the defendants have agreed to make reasonable accommodations for persons who use guide dogs," said Grace Chung Becker, Acting Assistant Attorney General for the Civil Rights Division. "Operation Home Sweet Home has helped to ensure that persons with disabilities are not discriminated against in their search for a place to call home." Under the agreement, subject to court approval, the defendants, National Properties Inc., NPI Management Corporation, Barrcrest Manor Associates, and the former apartment manager, Sandy Brown, will pay up to $25,000 to compensate any victims of discrimination at Barrcrest Manor. They will also pay $35,500 in civil penalties to the United States government, establish and follow non-discriminatory tenancy procedures, and undergo fair housing training. The federal Fair Housing Act prohibits discrimination in housing based on race, color, religion, national origin, sex, disability and familial status. Since Jan. 1, 2001, the Civil Rights Division has filed 271 cases to enforce the Fair Housing Act, 125 of which have alleged discrimination based on disability. More information about the Civil Rights Division and Operation Home Sweet Home is available at HYPERLINK "http://www.usdoj.gov/crt"http://www.usdoj.-gov/crt . The future service animals are owned by the Eye Dog Foundation for the Blind, a California-based non-profit group that operates a training center in Phoenix. But a large group of volunteers, foster families that agreed to help raise the dogs, are refusing to return them. "I couldn't feel comfortable handing this dog back to a foundation that is not functioning and feel good about it," Diana Anderson said. Anderson and 24 other volunteers entered into agreements with the foundation to provide the dogs a home and bring them to training sessions at the foundation's facility in South Phoenix. The goal of the foundation is to train the dogs and then place them with the blind. But volunteers like Eldon Ploetz say the foundation is in shambles, that dogs are not receiving the necessary training, and they claim not a single dog has been placed with a blind person in more than a year. Ploetz and his wife have helped raise and foster Kiesha, a German shepherd. In late September, Ploetz received a letter from the Eye Dog Foundation's attorney stating, "DEMAND IS HEREBY MADE that you immediately return Kiesha to the Foundation." The letter continues, "I understand that you have breached at least two parts of this Agreement. You have not followed the instructions of the staff, and you have not attended all the Training Classes." Other volunteers received similar letters. But the volunteers claim the trainers are not properly certified, and the ones that have been hired have not stayed on with the foundation. Additionally, they say the Foundation had been shut down for weeks and they have neglected the dogs. "We understand they cut off the food for the dogs that were in the kennel," Ploetz said. Ploetz's wife said she would rather go to jail than give the Kiesha back to the foundation. "They are valid concerns," said Dacoda Whittemore, a former operations manager who worked at the foundation's training facility for only a week. Whittemore said the dogs are "absolutely" receiving better care with the foster families, "not just because the management isn't functioning properly, but there?s no staff qualified on the foundation at this point to be able to take and care for these dogs properly." Dexter Morin, a former trainer at the facility agreed with Whittemore, submitting his resignation earlier this month. Before leaving, Morin turned over several dogs to the foster families rather than leaving them at the training facility alone. In his resignation letter, Morin wrote, "I contacted the puppy raisers to inform them of my concerns of leaving the dogs on the premises without the guarantee that they would be attended to." Morin goes on to state, "I in good conscience turned them over to the puppy raisers for the safe keeping of the dogs." The Eye Dog Foundation and its attorney have declined our repeated requests for an on-camera interview. In a statement to ABC15, the Foundation's attorney, John D. Clark, wrote, "The contract clearly states that each of the dogs belong to the Foundation, and gives no ownership rights whatsoever to any of the puppy raisers." The letter goes on to state that "the Foundation directed each of the puppy raisers in writing to return the Foundation's puppies to the Foundation within five days. It now appears that the puppy raises are refusing to comply with the Foundation's directive." Let us know what you think. Please post your comments below. Statement from attorney on behalf of the Eye Dog Foundation for the Blind The Eye Dog Foundation for the Blind is a non-profit California corporation that was established as the name suggests, to provide guide dogs for the blind. It is authorized to operate in Arizona. The Eye Dog Foundation for the Blind owns more than 25 puppies that were placed under bailment contracts with parties who were to raise the puppies, i.e., puppy raisers. Each of the Contracts clearly states that each of the dogs belong to the Foundation, and gives no ownership rights whatsoever to any of the puppy raisers. The puppy raisers merely had the right to raise these puppies. The Contract also stipulates that the puppy raisers were required to comply with the Foundation?s directives regarding the puppies. Last week, the Foundation directed each of the puppy raisers in writing to return the Foundation?s puppies to the Foundation within five days. It now appears that the puppy raisers are refusing to comply with the Foundation?s directive to return the Foundation?s puppies. The puppy raisers are apparently attempting to raise a number of specious issues to divert attention away from their clear breaches of the bailment contracts. None of these issues give the puppy raisers the right to deprive the Foundation of its puppies, which the puppy raisers are apparently attempting to do. Copyright 2008 The E.W. Scripps Co. You will recall that in my last posting about the Peticure, I had received a defective model. This has been replaced with a working model, and it works splendidly. As I said earlier, there is some assembly required before you can begin filing your dog's nails. The most important thing to notice is that the sanding band is not too low in the chuck. Otherwise, you won't be able to get enough tork to use the peticure effectively. With assembly completed, I've been using this tool for a few weeks now. It lives up to expectations. My dog's nails are short, smooth and flattened nicely. The process of filing all four paws takes less than two minutes and it is completely safe. Once your dog gets used to the wurring noise, you can trim nails while the dog is asleep. It took me only about one day to train Edison not to be nervous around the Peticure tool. I buzzed it around his head while he was having dinner. That was all there was to it. With this tool, you can safely cut your dog's nails with no pain, no fear and no assistance from anybody else. It does require more frequent filing than you would use with a clipper. I give Edison a once over lightly about every three weeks. The battery has never had to be charged after the initial time. The guard into which you place the dog's nails works well so that you always know where the nail is. This is a real help to me and my dog thanks me for doing his nails this way. The one small complaint I have is that the motor could use a little more tork, but this is a small thing. Now, there's a new thing called the Petipaws, which looks and sounds exactly the same as the Peticure. For more information, you can visit the web site at www.peticure.com. There's a handy video that lets you hear just how fast to set the rotary file. All in all, this is a fine product. Setting the variable speed wheel to between four and five seems to work optimally. So you're humming along at about a third octave a natural. Ken Volonte From shannonldillon at hotmail.com Tue Oct 21 08:14:58 2008 From: shannonldillon at hotmail.com (Shannon L. Q: What are the laws that apply to my business? Block quote start A: Under the Americans with Disabilities Act (ADA), privately owned businesses that serve the public, such as restaurants, hotels, retail stores, taxicabs, theaters, concert halls, and sports facilities, are prohibited from discriminating against individuals with disabilities. The ADA requires these businesses to allow people with disabilities to bring their service animals onto business premises in whatever areas customers are generally allowed. Block quote end 2. Q: What is a service animal? Block quote start A: The ADA defines a service animal as any guide dog, signal dog, or other animal individually trained to provide assistance to an individual with a disability. If they meet this definition, animals are considered service animals under the ADA regardless of whether they have been licensed or certified by a state or local government. Service animals perform some of the functions and tasks that the individual with a disability cannot perform for him or herself. Guide dogs are one type of service animal, used by some individuals who are blind. This is the type of service animal with which most people are familiar. But there are service animals that assist persons with other kinds of disabilities in their day-to-day activities. Some examples include: Block quote start _ Alerting persons with hearing impairments to sounds. _ Pulling wheelchairs or carrying and picking up things for persons with mobility impairments. _ Assisting persons with mobility impairments with balance. Block quote end A service animal is not a pet. Block quote end 3. Q: How can I tell if an animal is really a service animal and not just a pet? Block quote start A: Some, but not all, service animals wear special collars and harnesses. Some, but not all, are licensed or certified and have identification papers. If you are not certain that an animal is a service animal, you may ask the person who has the animal if it is a service animal required because of a disability. However, an individual who is going to a restaurant or theater is not likely to be carrying documentation of his or her medical condition or disability. Therefore, such documentation generally may not be required as a condition for providing service to an individual accompanied by a service animal. Although a number of states have programs to certify service animals, you may not insist on proof of state certification before permitting the service animal to accompany the person with a disability. Block quote end 4. Q: What must I do when an individual with a service animal comes to my business? Block quote start A: The service animal must be permitted to accompany the individual with a disability to all areas of the facility where customers are normally allowed to go. An individual with a service animal may not be segregated from other customers. Block quote end 5. Q: I have always had a clearly posted "no pets" policy at my establishment. Do I still have to allow service animals in? Block quote start A: Yes. A service animal is not a pet. The ADA requires you to modify your "no pets" policy to allow the use of a service animal by a person with a disability. This does not mean you must abandon your "no pets" policy altogether but simply that you must make an exception to your general rule for service animals. Block quote end 6. Q: My county health department has told me that only a guide dog has to be admitted. If I follow those regulations, am I violating the ADA? Block quote start A: Yes, if you refuse to admit any other type of service animal on the basis of local health department regulations or other state or local laws. The ADA provides greater protection for individuals with disabilities and so it takes priority over the local or state laws or regulations. Block quote end 7. Q: Can I charge a maintenance or cleaning fee for customers who bring service animals into my business? Block quote start A: No. Neither a deposit nor a surcharge may be imposed on an individual with a disability as a condition to allowing a service animal to accompany the individual with a disability, even if deposits are routinely required for pets. However, a public accommodation may charge its customers with disabilities if a service animal causes damage so long as it is the regular practice of the entity to charge non-disabled customers for the same types of damages. For example, a hotel can charge a guest with a disability for the cost of repairing or cleaning furniture damaged by a service animal if it is the hotel's policy to charge when non-disabled guests cause such damage. Block quote end 8. Q: I operate a private taxicab and I don't want animals in my taxi; they smell, shed hair and sometimes have "accidents." Am I violating the ADA if I refuse to pick up someone with a service animal? Block quote start A: Yes. Taxicab companies may not refuse to provide services to individuals with disabilities. Private taxicab companies are also prohibited from charging higher fares or fees for transporting individuals with disabilities and their service animals than they charge to other persons for the same or equivalent service. Block quote end 9. Q: Am I responsible for the animal while the person with a disability is in my business? Block quote start A: No. The care or supervision of a service animal is solely the responsibility of his or her owner. You are not required to provide care or food or a special location for the animal. Block quote end 10. Q: What if a service animal barks or growls at other people, or otherwise acts out of control? Block quote start A: You may exclude any animal, including a service animal, from your facility when that animal's behavior poses a direct threat to the health or safety of others. For example, any service animal that displays vicious behavior towards other guests or customers may be excluded. You may not make assumptions, however, about how a particular animal is likely to behave based on your past experience with other animals. Each situation must be considered individually. Although a public accommodation may exclude any service animal that is out of control, it should give the individual with a disability who uses the service animal the option of continuing to enjoy its goods and services without having the service animal on the premises. Block quote end 11. Q: Can I exclude an animal that doesn't really seem dangerous but is disruptive to my business? Block quote start A: There may be a few circumstances when a public accommodation is not required to accommodate a service animal--that is, when doing so would result in a fundamental alteration to the nature of the business. Generally, this is not likely to occur in restaurants, hotels, retail stores, theaters, concert halls, and sports facilities. But when it does, for example, when a dog barks during a movie, the animal can be excluded. Block quote end If you have further questions about service animals or other requirements of the ADA, you may call the U.S. Department of Justice's toll-free ADA Information Line at 800-514-0301 (voice) or 800-514-0383 (TDD). I've been using the peticure for a few weeks now, and I can say that it has a rather annoying problem. The sanding bands ware out very fast. I doubt that one could file a dog's nails more than twice before replacing the sanding band. When the band is gone, the tool makes a grinding sound that can't be overlooked. It sounds like metal on metal. I'll use a dremmel next week for comparison, but right now, it looks like the dremmel will win out.
