Taxi driver rejected guide dog

By GAVIN LOWER, COURT REPORTER

THE day before a blind man was due to give evidence about a taxi driver who
would not accept his guide dog, another driver refused to let his dog into a

taxi, the District Court heard yesterday.

Peter Ellson, 60, of Kingscote, Kangaroo Island, said he was refused a ride
by a taxi driver at Adelaide Airport, after flying in on Tuesday to give
evidence yesterday.
"He said he won't take the dog . . . said 'no' and just drove off," Mr
Ellson told the court.

Taxi driver Nariman Fathi has appealed to the court to be given back his
taxi licence, after he was disqualified for three years for refusing to
accept Mr Ellson and his dog in February, 2006.

Mr Fathi, who was also fined $2700, has told the court he was unaware of the

regulations requiring him to take guide dogs at the time he was sent to pick

up Mr Ellson at the Highlander Hotel, Gilles Plains.

But the court heard Mr Fathi scored 100 per cent on a test about taxi
regulations during his training to obtain a taxi licence.

Mr Ellson said he had tried to explain to Mr Fathi he had to take guide dogs

but he was "rude and arrogant and would not listen". The court heard Mr
Fathi left but later returned to pick up Mr Ellson after being told by his
company he had to take guide dogs.

Mr Ellson refused to go with Mr Fathi and denied his claim that he had
apologised.

"If he apologised I would have got into the taxi," he said.

Master Peter Norman reserved his decision on Mr Fathi.
